NOTICE OF TRUSTEE’S SALE

NOTICE OF TRUSTEE’S SALE is hereby given pursuant to and by virtue of the authority vested in the Substitute Trustee, WV Trustee Services, LLC, by that certain Deed of Trust dated August 5, 2015, executed by Borrowers, Melanie Lei Ann Frazier and Steven Wayne Miller, to Andrew C. Skinner, the Trustee of record in the office of the Clerk of the County Commission of Mercer County, West Virginia, in Book 1300, at Page 534. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 192 Sassafras Ln, Princeton, WV 24739. WV Trustee Services, LLC were appointed as Substitute Trustees by APPOINTMENT OF SUCCESSOR TRUSTEE dated October 9, 2018, of record in the Clerk’s Office in Book 1362, Page 458. The borrowers defaulted under the Note and Deed of Trust and the Substitute Trustees have been instructed to foreclose under the Deed of Trust. Accordingly, the Substitute Trustees will sell the following described property to the highest bidder at the front door of the Courthouse of Mercer County, in Princeton, West Virginia, on the following date:

25th day of January, 2019
at 12:15 p.m.

The property is described as of that certain lot or parcel of land, together with the improvements thereon and the appurtenances thereunto belonging, situate in Beaver Pond District, Mercer County, West Virginia, and being more particularly described as follows:

All that certain lot or parcel of land in Beaver Pond District of Mercer County, West Virginia, designated as Lot 3 on a Map bearing the legend “Plat of Survey Showing Lot 3 In Block 3, Section 1 Of Oakland Terrace, Which Is Situate Near Glenwood Park In Beaver Pond District, Mercer County, West Virginia, Dana Pettrey & Associates, P.O. Box 641, Athens, West Virginia, Date: 2/2/81, Scale: 1″ = 30′,” which Map is of record in the Office of the Clerk of the County Court of Mercer County, West Virginia, as Microfilm Plat No. 7865, and which said property is more particularly bounded and described as follows:
Beginning at an iron pin in the west line of Sassafras Lane at the common corner of Lots 3 and 5 as shown upon said Map; thence with the dividing line between said Lots 3 and 5, S. 84 degrees 30′ E. 158.111 feet to an iron pin in the east line of Oakland Drive; thence along and with Oakland Drive S. 16 degrees 30′ W. 84.553 feet to an iron pin set at the common corner of Lots 1 and 3; thence with the dividing line between said Lots 1 and 3, N. 84 degrees 30′ W. 141.978 feet to an iron pin in the east line of Sassafras Lane, and thence along with the same N. 5 degrees 30′ E. 83.00 feet to the point of beginning, containing 0.286 of an acres, more or less.
This conveyance is subject to the Declaration of Protective Covenants, Reservations and Restrictions pertaining to lots in said Subdivision, of record in said Clerk’s Office in Deed Book 516, at Page 317, and the Amendment to said Declaration, of record in said Clerk’s Office in Deed Book 602, at Page 263.
There is expressly excepted and reserved an easement over, under and through said property for the installation of utility lines for the benefit of the Subdivision, the same to be installed as near its property line or lines as practicable.

Being the same property conveyed to Melanie Lei Ann Frazier and Steven Wayne Miller by the Deed dated August 5, 2015 and recorded in Deed Book 1022 at Page 355 in the Office of the Clerk of the County Commission of Mercer County, West Virginia.

TERMS OF SALE:

1) The property will be conveyed in an “AS IS” physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the Clerk’s office or affecting the subject property.

2) The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code 11-22-1.

3) The Beneficiary and/or the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale.

4) The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee.

5) The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY.

6) The total purchase price is payable to the Trustee within thirty (30) days of the date of sale, with ten (10{4ceb532c6f579389df471c6c1e832caf2346b74dc60fcbf6aabd4d29df3baf9c}) of the total purchase price payable to the Trustee at sale.
