NOTICE OF TRUSTEE’S SALE

NOTICE OF TRUSTEE’S SALE is hereby given pursuant to and by virtue of the authority vested in the Substitute Trustee, WV Trustee Services, LLC, by that certain Deed of Trust dated July 5, 2007, executed by Borrower, Terry Hope, to Richard A. Pill, the Trustee of record in the office of the Clerk of the County Commission of Mercer County, West Virginia, in Book 1115, at Page 738; re-recorded July 31, 2007, in Book 1117, Page 275. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 2835 Marellen Ave, Bluefield, WV 24701. WV Trustee Services, LLC were appointed as Substitute Trustees by APPOINTMENT OF SUCCESSOR TRUSTEE dated August 29, 2018, of record in the Clerk’s Office in Book 1361, Page 262. The borrower defaulted under the Note and Deed of Trust and the Substitute Trustees have been instructed to foreclose under the Deed of Trust. Accordingly, the Substitute Trustees will sell the following described property to the highest bidder at the front door of the Courthouse of Mercer County, in Princeton, West Virginia, on the following date:

25th day of January, 2019
at 12:00 p.m.

The property is described as of that certain lot or parcel of land, together with the improvements thereon and the appurtenances thereunto belonging, situate in Beaver Pond District, Mercer County, West Virginia, and being more particularly described as follows:

All those two certain lots or parcels of real estate now situate in the City of Bluefield, Mercer County, West Virginia, and designated on the Mercer County Sheriff’s Tax Map 47 as Parcels 19 and 20, and which said property is more particularly bounded and described as follows:
PARCEL NO. 1:
All that certain lot or parcel of land situate in Beaver Pond District, Mercer County, West Virginia, as Lot No. 20, Block No. 2, and more particularly bounded and described as follows, to-wit:
Beginning at a point in the eastern line of Marellen Avenue, N. 19 degrees 09′ W. 236.6 feet distant from the point of intersection of the eastern line of said avenue with the northern line of the Cumberland Gap and Fincastle Turnpike, said point being the northwest corner of Lot No. 21, Block No. 2, of said above-mentioned Extension; thence along the eastern line of Marellen Avenue, N. 19 degrees 09′ W. 50 feet to a point, the southwest corner of Lot No. 19, Block 2; thence along the southern line of said Lot No. 19, N. 70 degrees 51′ E. 175 feet to a point, the northwest corner of Lot No. 24, Block No. 2; thence with the western line of said Lot No. 24, S. 19 degrees 09′ E. 50 feet to a point, the southwest corner of Lot No. 24, and the northeast corner of Lot No. 21; thence along the northern line of said Lot 21, S. 70 degrees 51′ W. 175 feet to the point of beginning.
PARCEL NO. 2:
All that certain lot or parcel of land situate in Beaver Pond District, Mercer County, West Virginia, and more particularly described as follows:
The property herein conveyed as shown on a map made by Elmer C. Barton, a Civil Engineer, and duly recorded in the Office of the Clerk of the County Court of Mercer County, West Virginia, said map being known as Cumberland Heights Extension No. 2, and the property herein conveyed is shown on said Subdivision map as Lot No. 21, Block No. 2, of said Extension No. 2.

Being the same property conveyed to Terry Hope by the Deed dated June 27, 2007 and recorded in Deed Book 913 at Page 261 in the Office of the Clerk of the County Commission of Mercer County, West Virginia.

TERMS OF SALE:

1) The property will be conveyed in an “AS IS” physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the Clerk’s office or affecting the subject property.

2) The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code 11-22-1.

3) The Beneficiary and/or the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale.

4) The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee.

5) The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY.

6) The total purchase price is payable to the Trustee within thirty (30) days of the date of sale, with ten (10{4ceb532c6f579389df471c6c1e832caf2346b74dc60fcbf6aabd4d29df3baf9c}) of the total purchase price payable to the Trustee at sale.
