NOTICE OF TRUSTEE’S SALE

NOTICE OF TRUSTEE’S SALE is hereby given pursuant to and by virtue of the authority vested in the Substitute Trustee, WV Trustee Services, LLC, by that certain Deed of Trust dated November 4, 2011, executed by Borrowers, Eric A Hitt and Karri B Hitt, to Gary R. Mills, the Trustee of record in the office of the Clerk of the County Commission of Mercer County, West Virginia, in Book 1221, at Page 189. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 203 Edwards St, Princeton, WV 24740. WV Trustee Services, LLC were appointed as Substitute Trustees by APPOINTMENT OF SUCCESSOR TRUSTEE dated November 28, 2018, of record in the Clerk’s Office in Book 1365, Page 1. The borrowers defaulted under the Note and Deed of Trust and the Substitute Trustees have been instructed to foreclose under the Deed of Trust. Accordingly, the Substitute Trustees will sell the following described property to the highest bidder at the front door of the Courthouse of Mercer County, in Princeton, West Virginia, on the following date:

The property is described as of that certain lot or parcel of land, together with the improvements thereon and the appurtenances thereunto belonging, situate in East River District, Mercer County, West Virginia, and being more particularly described as follows:

the eastern portion of Lot No. 10 and the western portion of Lot No. 11, shown upon a Map entitled, ‘Map of Park View Heights situated in East River District, Mercer County, West Virginia, by Glenn Land Company, Scale 1″ equal 40′ July 23, 1953, by F. E. Walker, Engr.’, which said Map is incorporated in and recorded with a deed from Robert Effron and Charlotte M. Effron to James A. Watts and Roma D. Watts, dated July 28, 1953, and of record in the Office of the Clerk of the County Court of Mercer County, West Virginia, in Deed Book No. 334, at Page 378, which said property is more particularly bounded and described as follows:
BEGINNING at a stake at a power pole in the south line of Edward Avenue which stake is S. 78deg. 24′ W. 140.325 feet from Charlotte Street; thence running along and with Edward Avenue, N. 78deg. 24′ E. 70.16 feet to a point in the north line of Lot No. 11; thence leaving Edward Avenue and running through Lot No. 11, S. 00deg. 06′ W. 145.72 feet to a point in the dividing line of Lot No. 11 and Lot No. 4; thence along and with said dividing line N. 89deg. 54′ W 68.75 feet to a point in the dividing line of Lot No. 10 and Lot No. 5; thence leaving said line and running through Lot No. 10 N. 00deg. 06′ E. 131.69 feet to the point of BEGINNING, and containing the Eastern portion of Lot No. 10 and the Western portion of Lot No. 11.

Being the same property conveyed to Eric A Hitt and Karri B Hitt by the Deed dated November 4, 2011 and recorded in Deed Book 969 at Page 405 in the Office of the Clerk of the County Commission of Mercer County, West Virginia.

TERMS OF SALE:

1) The property will be conveyed in an “AS IS” physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the Clerk’s office or affecting the subject property.

2) The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code 11-22-1.

3) The Beneficiary and/or the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale.

4) The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee.

5) The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY.

6) The total purchase price is payable to the Trustee within thirty (30) days of the date of sale, with ten (10{4ceb532c6f579389df471c6c1e832caf2346b74dc60fcbf6aabd4d29df3baf9c}) of the total purchase price payable to the Trustee at sale.
