ORDER OF PUBLICATION
To Whom It May Concern:
The purpose of this action is to protect the child respondents, J.K., A.K., C.M., and C.M., from abuse and neglect. The Petitioner, the West Virginia Department of Health and Human Resources, is seeking legal and physical custody of said child respondents, J.K., A.K., C.M., and C.M. Further, the Petitioner is seeking to locate Douglas Kincaid, the biological father of the child respondents J.K., who was born on August 27, 2013 and A.K., who was born on March 12, 2011, and Justin Muovich, the biological father of the child respondents, C.M., who was born on September 26, 2005, and C.M., who was born on May 20, 2004 and Douglas Kincaid.
Counsel for the Petitioner, the West Virginia Department of Health and Human Resources, is Ray W. Toney, Assistant Prosecuting Attorney, 108 East Maple Avenue, Fayetteville, West Virginia 25840.
It appearing that the whereabouts of Douglas Kincaid and Justin Muovich are presently unknown at this time, it is Ordered that Douglas Kincaid and Justin Muovich obtain from the Fayette County Circuit Clerk at the Fayette County Courthouse, Fayetteville, West Virginia, the Petition filed in this matter. Douglas Kincaid and Justin Muovich must appear and defend on or before Thursday, October 3, 2019, at 10:15 a.m., in the Courtroom of the Honorable Thomas H. Ewing, Fayette County Courthouse Judicial Annex, Fayetteville, West Virginia, at which time an adjudicatory hearing will be held. Also, on or before Thursday, November 7, 2019, at 11:00 a.m., in the Courtroom of the Honorable Thomas H. Ewing, Fayette County Courthouse Judicial Annex, Fayetteville, West Virginia, at which time a disposition hearing will be held. Failure to answer and defend could result in a default judgment, and loss of parental rights.
Further, it is hereby Ordered that Douglas Kincaid and Justin Muovich be advised of his right to have counsel at every stage of these proceedings. Douglas Kincaid and Justin Muovich is further advised that such proceedings may result in the severance of parental rights and the transfer of custody of said children unto the Petitioner.
The child respondents, J.K., A.K., C.M., and C.M., shall be represented by counsel at every stage of these proceedings. The Guardian ad Litem appointed for said child is Christopher Moorehead, 219 North Court Street, Fayetteville, WV, (304) 574-3291.
