The purpose of this action is to request the court to permit the sale of certain real estate owned by Ruth A. Bennett, a protected person, said real estate being situated in the Blue Sulphur District, Greenbrier County, West Virginia, containing 32,216 square feet, more or less and being more particularly described in that certain deed of conveyance dated January 24, 2000, from Berline M. Sears to William J. Bennett and Ruth A. Bennett, his wife, and of record in the office of the Clerk of the County Commission of Greenbrier County, West Virginia, in Deed Book No. 460 at page 932. A copy of the aforesaid deed is attached to the petition in the above-captioned matter, and is filed therewith in the office of the Circuit Court Clerk of Greenbrier County, West Virginia. The Sheriff of Greenbrier County, West Virginia, seeks, by way of the subject petition, leave of the court to sell the subject real estate to Earl D. Hanna for the sum of $8,000.00, on behalf of Ruth A. Bennett, in his duly appointed capacity as her conservator. The petition is filed with the court pursuant to the provisions of West Virginia Code Section 44A-3-5.
It appearing that the whereabouts of William J. Bennett, Billy Jo Bennett and Bobby Jo Bennett are unknown, and such persons are statutorily designated as interested persons in the subject petition. As such, each are hereby given NOTICE that a hearing on the subject petition will be held before the Honorable Thomas W. White, Mental Hygiene Commissioner of Greenbrier County, West Virginia, in the Greenbrier County Courthouse, 200 North Court Street, Lewisburg, West Virginia 24901, on October 30, 2015, at 2:00 PM. Each of the said persons of interest may appear at such time and place and be heard by the court. Failure to appear at such time and place, or to otherwise respond to the subject petition, will not preclude the court from proceeding to final disposition of this matter, if the court, in its discretion, determines it is appropriate to proceed accordingly. A copy of the petition in this matter is available in the office of the Circuit Court Clerk of Greenbrier County, West Virginia. The petitioner’s attorney is Patrick I.
