NOTICE OF SALE OF VALUABLE REAL ESTATE BY SPECIAL COMMISSIONERS

Pursuant to an Order of the Circuit Court of Greenbrier County, West Virginia, made and entered on the 22nd day of August 2016 in the above-styled civil action, the undersigned Special Commissioners will on the 12th day of December 2016 at the front door of the Courthouse of Greenbrier County, locat-ed at 200 Court Street, North, Lewisburg, Greenbrier County, West Virginia 24901, at 11:00 AM in the forenoon of said day, offer for sale to the highest responsible bidder or bidders thereat, the following described lots or parcels of land located in White Sulphur District of Greenbrier County, West Virginia, and being described as follows:
TRACT NO. 1: 179.50 Acres, more or less (179 Acres 80 Poles), and described as being Northeast of White Sulphur Springs, and North of 1-64, and identified as Map/Parcel No. 23/0020;
TRACT NO. 2: Four (4) Acres and described as being on the Waters of Waids Creek and Northeast of White Sulphur Springs, and identified as Map/Parcel No. 23/0022;
TRACT NO. 3: 30 Acres, and described as being Northeast of White Sulphur
Springs, and North of 1-64, and ident-ified as Map/Parcel No. 23/0021;
TRACT NO. 4: That certain tract of land situate and being in Hamilton Addition of the Village of White Sulphur Springs, and containing 19.6 Acres, more or less, and identified as Map/Parcel No. 23/2.
TERMS OF SALE:
1. Sale is subject to subsequent confirmation by the Circuit Court of Greenbrier County, West Virginia;
2. Deed will be by Special Warranty from the undersigned Special Commissioners to the purchasers;
3. Cash payment at time of sale, or an irrevocable letter of credit addressed to the undersigned Commissioners guaranteeing payment of the purchase price;
4. The 2016 real estates taxes and all subsequent taxes shall be the purchaser’s obligation;
5. The Special Commissioners reserve the right to sell all tracts individually and/or grouped in such manner as the Special Commissioners shall determine in order to attain the highest and best price therefore;
6. This sale is subject to continuance for good cause by/or declaration of the Commissioners at time of sale;
7. Property is sold “AS IS-WHERE IS”
as to conditions regarding improvements;
8. Purchaser is responsible to obtain and pay for any title examinations which must be conducted prior to sale and bidding thereon; and
9. Purchasers will pay all transfer stamps and recording fees.
