TO: RESPONDENTS, STEPHEN DALE BOURGEOIS, FRONTIER WEST VIRGINIA INC., COLUMBIA GAS TRANSMISSION, LLC, UNKNOWN PERSONS/ OWNERS, AND TONY BOGGS, SHERIFF OF JACKSON COUNTY, WEST VIRGINIA Notice is hereby given to Stephen Dale Bourgeois, Frontier West Virginia Inc., Columbia Gas Transmission, LLC, Unknown Persons/Owners, and Tony Boggs, Sheriff of Jackson County, West Virginia (hereinafter sometimes referred to as "the aforementioned respondents"), that a Petition for Condemnation/Right of Entry has been filed in the Circuit Court of Jackson County, West Virginia, and is known as Civil Action No. CC-18-2025-C-80, and styled Appalachian Power Company vs. Stephen Dale Bourgeois, et al. Said Petition for Condemnation/Right of Entry under the West Virginia laws of eminent domain seeks property for the construction of electrical transmission, distribution, and communication lines and appurtenant equipment and fixtures, and condemnation and right of entry on behalf of Appalachian Power Company situate in Ravenswood District, Jackson County, West Virginia, identified as Tax Map 33, Parcel 7, and recorded in the office of the Clerk of the County Commission of Jackson County, West Virginia, in Deed Book No. 273, at page 428, and being more specifically bounded and described as follows: B53 AC DRY FORK FIRST TRACT: Beginning at a stone in the line between the lands of Mary E. Clerc and Thomas Bennett; thence with said line S. 50 W. 42 poles to a stake in the public road, being corner to school house lot; thence along and in said public road N. 83 W. 27 poles to a stake in the Ravenswood and Ripley turnpike at a fork of the roads; thence two lines with said pike N. 44 W. 24 1/2 poles to a stake; N. 21 W. 58 poles to a stake in center of pike where the Dry Fork joins the same; thence three lines down along said Dry Fork road N. 23 1/2 E. 25-3/4 poles to a stake in the road; N. 41 E. 21 1/2 poles to a stake; N. 78 1/2 E. 16 poles to a stake in center of road with white oak pointers on the lower edge of said road; thence leaving the road S. 31 1/2 E. crossing heads of Dry Fork 110 poles to the beginning, containing 41 1/4 acres, more or less. SECOND TRACT: Beginning at a stone in the Dry Fork Road; thence leaving said road S. 31 1/2 E. 96 poles to a stake in line of F.A. Bennett heirs; thence S. 63 W. 18 poles to F.A. Bennett's stone corner; thence with his line N. 31 1/2 W. 108 1/2 poles to a stake in Dry Fork Road near W.O. pointers; thence with the meanderings of said road to the place of beginning; containing 11-3/4 acres, more or less. THIRD TRACT: Beginning at a stake opposite a hickory at a point in the County Road where the line between Clerc's 200 acre Lot No. 1 of Stringer's land crosses said road; thence with the line of said lot N. 76 E. 54 1/2 poles to a stake and pointers, corner to Lot No. 6 of Stringer's survey; thence N. 37 1/2 W. 39 poles to the Clerc line aforesaid marked by a stake; thence with the Clerc line to the beginning, containing 10 acres, more or less. FOURTH TRACT: Beginning at a hickory bush on the County Road; thence N. 67 E. 19 poles and 15 links to a stake; thence N. 40 1/2 E. 12 poles to a stake; thence N. 25 E. 6 poles and 16 links to a stake corner to J. Bennett; thence N. 37 1/2 W. 41 poles to a stake; thence S. 51-3/4 W. 38 poles to a stake; thence S. 37 1/2 E. 41 poles to the place of beginning, containing 10 acres, more or less. The aforementioned respondents are hereby notified the said Petition for Condemnation/Right of Entry has previously been served and notice published and may be obtained from the Jackson County Circuit Clerk's office at 100 Court Street, Ripley, West Virginia, 25271, for the purposes of appearing and defending. The Petition for Condemnation/ Right of Entry may also be obtained from the attorneys for AEP West Virginia Transmission Company, Inc., Stephen F. The aforementioned respondents are further notified that a hearing on the said Petition for Condemnation/Right of Entry will occur on November 7, 2025, at 9:30 a.m., in the Circuit Court of Jackson County, West Virginia, located at 100 Court Street, Ripley, West Virginia, 25271, before the Honorable Lora Dyer. You may appear for hearing as stated above and are notified that any failure to appear may result in the waiver of any defenses or claims, if any, you may have.
