SALE OF VALUABLE IMPROVED REAL ESTATE
Pursuant to and by virtue of an Order Confirming Special Commissioner’s Report and Directing Sale of Real Estate entered by the Circuit Court of Jefferson County, West Virginia, on the 12th day of May, 2025, in a case therein pending, Case No. CC-19-2023-C-121, under the style of “Homeowner’s Association of Green Meadows, Inc., Plaintiff, v. Darren Casper and Shannon Casper, Defendants,” the undersigned Bonded Special Commissioner will offer for sale at public auction to the highest bidder to be held at the front door of the Jefferson County Court House, situate at 100 E. Washington Street, Charles Town, Jefferson County, West Virginia, on Monday, June 9, 2025, at 11:30 a.m., all that certain parcel of real estate, together with the improvements thereon and the appurtenances thereunto belonging, situate in the Charles Town Corp District, Jefferson County, West Virginia, being more particularly bounded and described as follows (the “Property”):
Being all of Lot 25, as the same is designated and described on a plat entitled “plat of Correction Final Plat of Subdivision Lots 1-67 Green Meadows” made by Associated Engineering Services, Inc., dated July, 2003, said plat being recorded in the Office of the Clerk of the County Commission of Jefferson County, West Virginia, in Plat Book 20, at Page 26, TOGETHER WITH a non-exclusive easement over Crescent Drive and all common use areas as shown on the aforesaid plat for all the usual purposes for access to and from said real estate.
Upon information and belief, the physical address of the Property is 23 Holmes Drive, Charles Town, West Virginia 25414. [Tax Map 9C, Parcel 25; Acct. 00008880]
AND BEING all and the same parcel of real estate which was conveyed to Defendants, Darren T. Casper and Shannon L. Casper, by virtue of a certain Deed, dated June 18, 2024, from Dan Ryan Builders, Inc., recorded in said Clerk’s Office in Deed Book 991 at Page 83.
THE CONVEYANCE OF THIS REAL ESTATE WILL BE MADE SUBJECT TO all easements, rightsofway, restrictive covenants, conditions, reservations, and other conditions of record found and enumerated in the chain of title and those reasonably apparent upon an inspection and view of said real estate or as determined by a survey.
THIS SALE SHALL ALSO BE MADE SUBJECT TO the rights of any person or persons occupying the Property, if any there be, and the Bonded Special Commissioner shall not be under any duty to cause any person or persons who may be occupying said Property to vacate the same. The property will be sold in an “AS IS” condition and the Bonded Special Commissioner makes no warranty of any type as to the condition of any improvements located in, on, upon or about the Property, if any there be. The Bonded Special Commissioner’s deed to any purchaser will not contain any warranty of title.
TERMS OF SALE
Cash or bank check on day of sale in an amount equal to ten percent (10%) of the purchase price, with the balance due, in cash or certified funds, forty-five (45) days from the date of confirmation of said sale by the Circuit Court of Jefferson County, West Virginia, to which in all respects this sale shall be subject. Announcements at the day of sale or by further order of said Court shall have precedence over this notice. All real estate taxes and all other charges and assessments levied against the property shall be pro-rated to the date of settlement. All recording fees and charges and all transfer and excise taxes shall be paid by the purchaser.
