NOTICE OF SALE
Pursuant to the authority vested in the undersigned, by Order of the Circuit Court of Pendleton County, West Virginia, entered on the 29th day of April, 2015, in Civil Action No. 14-P-15, entitled The Estate of Harry Hilton Goff, by and through its Co-Executors, Amy Lou Dean Armentrout, and Michael Loron Goff, Petitioner v. Harry Alan Goff, Donna L. Goff, Douglas Simmons, Sandra Simmons, Gene Cooper, Patricia Lane, John B. Lane, Wilmoth Cooper, Larry Cooper, Dorene Wilfong, Jonnie A. Lane Skidmore, Rosalita Carr, Sharon Hanley, the unknown heirs of Fred Harr, and the unknown heirs of Elijah J. Cooper, Respondents.,as Special Commissioners of said Court shall, on the Saturday, June 20, 2015, commencing at 11:00 a.m., proceed to sell at the front door of the courthouse of Pendleton County, West Virginia, at public auction, to the highest bidder, the following three pieces of parcel of real estate described as follows, to wit:

Those certain tracts or parcels of real estate lying in Dry Fork District, Randolph County, and Union District of Pendleton County, on the top of Allegheny Mountain, both Counties lying and being in the State of West Virginia, and more particularly bounded and described as follows:

FIRST TRACT: BEGINNING at a Chestnut Tree, the division corner between Christian Cooper and Daniel and Elijah Cooper in line of an 80 acre tract; thence S. 57 W. 48 poles to a stake on a line of said 80 acre tract; thence S. 31-1/2 E. 200 poles to a Chestnut Tree; thence N. 31-1/2 E. 53-1/3 poles to a stone pile, a division corner, N 31-1/2 W. 181 poles to the beginning, containing 53-1/3 acres, more or less, and as shown on the Land Books of Randolph County on Tax Map 153 as Parcel No. 0012 -Dry Fork District.

SECOND TRACT: Adjoining the aforesaid 53-1/3 acre tract and BEGINNING at a White Oak where a Chestnut is called for, thence S. 88 W. 36 poles to a sugar and chestnut, a former corner, N. 37 W. 76 poles to a large White Oak and Maple, N. 18 W. 28 poles to a small Beech, N 82 W. 60 poles to 2 sugars, N. 32 E. 28 poles to 2 small sugar trees on the old Rohrbaugh line, thence with said line S 34 E. 160 poles to the place of beginning, containing 29 acres, more or less, and as shown on the Land Books of Randolph County on Tax Map 15 3 as Parcel No. 0011 – Dry Fork District.

In addition, the following piece of parcel of real estate situated completely in Union District, Pendleton County, West Virginia, described as follows, to wit:
That certain tract or parcel of real estate, situate in Union District, Pendleton County, West Virginia, lying and being on the East side of, and extending to near the top of the Allegheny Mountain, and known as the Briar Patch tract, together with any and all appurtenant easements which may benefit same, and being more particularly bounded and described as follows:

On the North by land of Kennie Cooper and on the West by Decator Montoney, and on the South by lands of James R. Harper, and on the East by Daniel Cooper, Sr. And described as follows:

Beginning at a large red-oak tree on the South East side of the Allegheny Mountain, known as Green Knob, also a corner of the Anderson Land, and a corner of Kennie Cooper’s land, and a corner of Decator Montoney’s land; thence with the original line S 55 E 124 rods to a locust in James R. Harper’s line; thence S 58 E 75 rods to three hickories, thence N 10 E 20 rods to an oak; thence N 56 E 44 rods to a chestnut; thence S 77 E 16 rods to a sugar and beech; thence S 59 E 14 rods to two chestnuts and hemlock, thence N 17 W 20 rods to two hemlocks; thence N 22 W 30 rods to an oak and beech; thence N 40 W 38 rods to a red oak (now down) also Jesse Harman’s corner, thence with the meadow fence S 72 W 52 rods to a thorn bush on a flat; thence with an agreed division line, N 47 W 20 rods to a stake by the corner of a meadow; thence S 67 W 140 rods to the place of beginning, containing one hundred and eleven (111) acres, to be the same more or less, and being all of the same tract of land owned by the late Elijah Cooper at the time of his death.

The sale will be by the boundary and not by the acre without warranty as to the quantity of acreage contained on said real estate.
The sale shall be made without warranty of title and subject to all reservations, exceptions, covenants, restrictions, easements, limitations, conditions, mineral rights, rights of way or easements, and other servitudes, if any, made, retained or otherwise created by deeds or other instruments constituting the record chain of title to the real estate aforesaid.
The sale shall be made subject to any and all liens and encumbrances affecting the real estate and to all unpaid or any accrued real estate taxes assessed against the real estate.
This sale shall further be made subject to all necessary rights of way for ingress, egress and regress; water/sewer, and utility service to the real estate, if any.
Any sale hereunder may be postponed from time to time or adjoined without any notice other than an oral announcement at the time and place appointed for this sale or by posting notice. The Special Commissioners reserve the right to reject any and all bids.
This sale is subject to the approval and confirmation by the Circuit Court of Pendleton County, West Virginia.
Terms of Sale: Ten (10.00{4ceb532c6f579389df471c6c1e832caf2346b74dc60fcbf6aabd4d29df3baf9c}) of purchase price due on day of sale payable to the Special Commissioners and the balance in immediately available funds at closing, which shall be within forty-five (45) days from the day of sale.
