The object of the above-entitled action is a Petition for Partition of Real Estate by Sale of the real estate owned by all known and unknown heirs of Charley E. Richmond, or his/her heirs, known or unknown, successors or assigns; unknown heirs of Charlie Emmett Richmond, or her/his heirs, known or unknown, successors or assigns; unknown heirs of Everette Roosevelt Richmond, or his/her heirs, known or unknown, successors or assigns; unknown heirs of Ora Richmond Plumley, or his/her heirs, known or unknown, successors or assigns; unknown heirs of Emma F. Buckland, or his/her heirs, known or unknown, successors or assigns; unknown heirs of Ralph Doras Richmond, or his/her heirs, known or unknown, successors or assigns; unknown heirs of Estella Patton, or his/her heirs, known or unknown, successors or assigns; unknown heirs of Marrida E. Richmond, or his/her heirs, known or unknown, successors or assigns; unknown heirs of Susie Ethel Richmond, or his/her heirs, known or unknown, successors or assigns; unknown heirs of Susie Ethel Richmond, or his/her heirs, known or unknown, successors or assigns; unknown heirs of Ercell Christine Richmond Adkins, or his/her heirs, known or unknown, successors or assigns; unknown heirs of Martha Richmond, or his/her heirs, known or unknown, successors or assigns; and unknown heirs of Charlie Richmond, or his/her heirs, known or unknown, successors or assigns. Plaintiffs, by verified Petition, state that they do not know whereabouts of the Defendants, their heirs, successors or assigns. The property that is the subject matter of this lawsuit is identified on tax maps of Raleigh County in the Richmond District, on map 2, as parcel 00430000, and further described as Sur 14.147 AC Panther Branch.; being part of the same property that Charley Richmond acquired by Deed of E. Smith and Nancy A. Smith, dated January 6, 1897, of record in the Office of the Clerk of the County Commission of Raleigh County, in Book Q, at page 6; also being the same property that NEPSA, Limited Liability Company acquired by Deed of Ronnie Bennett, dated March 9, 2015, of record in the abovementioned Clerk's Office in Book 5058, at page 1183.
It appearing by Affidavit filed in this action that there may be defendant(s) unknown and defendant(s) who are nonresidents of the State for whom no agent or appointed or statutory agent or attorney in fact is found in the State upon whom service may be had to plaintiff.
It is ORDERED that Defendants, knowns or unknown, their heirs, successors or assigns, appear and serve upon Gavin G. Ward, counsel for Plaintiff, whose address is 228 N. Fayette Street, P.O. Box 5086, Beckley, West Virginia 25801, an answer or other defense to the Petition filed in this action on or before August 10, 2026; otherwise judgment by default will be taken against them.
It is hereby notified that on the 26th day of August, 2026, at 9:00 a.m., or as soon thereafter as counsel can be heard, the Plaintiff, will appear before the Circuit Court of Raleigh County, West Virginia, before Judge Todd Kirby, in the Raleigh County Judicial Anex, 222 Main Street, Beckley, West Virginia, for the further proceeding with respect to Plaintiff's abovementioned Petition, including but not limited to any potential motions for default judgement.
