ORDER OF PUBLICATION
The object of the above entitled action is to reform by Order, pursuant to West Virginia R. Civ.
P. 57 and West Virginia Code 55-13-1 et. seq., a certain Deed of Trust which secures the first lien mortgage loan upon the Respondent’s real estate. Such real estate, which is the subject of this action, was purported to be the home of the Respondent.
And it appearing by an affidavit filed in this action that personal service upon the Respondent was attempted by the Raleigh County Sheriff’s Department on multiple occasions, without effect; and that the Petitioner herein, despite the use of due diligence is unable to ascertain the whereabouts of the Respondent.
It is hereby ORDERED that Melinda S. Flint fka Melinda S. Richmond, do serve upon Paul Flanagan, Raleigh County Circuit Clerk, whose address is 222 Main Street, Beckley, WV 25801, and Ryan Keesee, Attorney for Petitioner, 55 Meridian Parkway, Suite 108, Martinsburg, WV 25404, an answer or other defense to the petition filed in this action on or before Thirty (30) days from the date of first publication, otherwise judgment by default will be taken against Melinda S. Flint fka Melinda S. Richmond at any time thereafter. A copy of said complaint can be obtained from the undersigned Clerk at his office.
