Pursuant to Rule 4(E) of the West Virginia Rules of Civil Procedure, the Circuit Court of Randolph County, West Virginia, upon review of the record, hereby enters an Order of Publication for service of the Complaint against the defendant, Ashley Bowman, as listed herein. An advertisement shall be published in a qualified newspaper, The Inter-Mountain, by running a legal advertisement once a week for two consecutive weeks.
The Order of PUblication shall give the style of the suit as follows: In the Circuit Court of Randolph County, West Virginia, AUSTIN CURRENCE AND THERESA CURRENCE, Plaintiffs, V. ASHLEY BOWMAN AND HALEY PLUM WILSON,Defendants, Civil Action No.: 15-C-46, before the Honorable Judge David H. Wilmoth.
The Order of Publication shall state that the object of the above entitled civil actions is as follows:
This action is for injuries and damages by the Plaintiffs Austin Currence and Theresa Currence against the Defendants for various violations of the traffic laws of the State of West Virginia associated with the motor vehicle collision which took place on or about May 25, 2013 at the intersection of First Street and Kerens Avenue in Elkins, Randolph County, West Virginia.
Further, the Order of Publication shall state that it is ordered that defendant is to serve upon the Circuit Clerk of Randolph County, West Virginia located at the Randolph County Courthouse at 2 Randolph Avenue, Elkins, WV 26241, an Answer or other defense to the Amended Complaint within 30 days of this publication otherwise that Judgment by Default will be rendered against Defendant Ashley Bowman.
Finally, the Order of Publication shall state that the Defendant, Ashley Bowman, can obtain a copy of the Amended Complaint from the Randolph County Circuit Clerk located at the aforementioned address.
