It appears by affidavit filed in this action that the Respondent is a non-resident of the State of West Virginia or has an unknown address and that the Petitioner has exercised due diligence, without success, to determine the current residence and current whereabouts of the Respondent.
Pursuant to the Rule 4(e) of the West Virginia Rules of Civil Procedures, the Respondent is notified that the style of the action filed by the Petitioner is listed above; that the object of the action is to obtain a divorce of and from the Respondent; that the Respondent may appear and defend any of her rights within the required time after service; and, that if the Respondent is properly served with notice and fails to respond within the required time after service, she may not appear in nor receive further notice of the divorce proceeding.
It is ordered that the Respondent file with the Circuit Clerk for Fayette County, West Virginia, an Answer, including any related counter-claim or defense she may have to the Petition for Divorce filed in this action on or before 30 days from the date of the first publication of this Order, with a copy of the same to be served upon the Petitioner’s attorney, Anthony Ciliberti, Jr., P. O. Box 621, Fayetteville, WV 25840. Failure to answer the Petition for Divorce may result in judgment being taken against you for the relief demanded in the petition. A copy of the Petition for Divorce may be obtained from the Circuit Clerk for Fayette County, West Virginia, 100 North Court Street, Fayetteville, WV 25840, 304-574-4249.
