TRUSTEE’S SALE OF VALUABLE REAL ESTATE

The undersigned Substitute Trustee, by virtue of the authority vested in him by that certain Deed of Trust dated May 30, 2003, and duly recorded in the Office of the Clerk of the County Commission of Marion County, West Virginia, in Deed of Trust Book 767, at Page 715, Colyn J. Jones and Anita C. Jones did convey unto Anthony J. Julian, Trustee, certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Richard A. Pill as Substitute Trustee by a Substitution of Trustee recorded in the aforesaid Clerk’s Office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by the secured party to foreclose thereunder, will offer for sale at public auction at the front door of the Marion County Courthouse, in Fairmont, West Virginia, on

Wednesday, January 14, 2015, at 1:00 PM

The following described real estate, with its improvements, easements and appurtenances thereunto belonging, situate in the Union District, Marion County, West Virginia, and more particularly described as follows:

PARCEL ONE: All that certain parcel of real estate, together with all buildings thereon and all appurtenances thereunto belonging, situated in Homewood Addition to the City of Fairmont (outside said City) in Union District, Marion County, West Virginia, a map of which said Addition is of record in the Office of the Clerk of the County Court (Commission) of said Marin County in Deed Book 247, at Page 402, said real estate being bounded and more particularly described as follows, that is to say:

ALL OF THE NORTHERN PORTION OF LOT NO. 38 OF SAID ADDITION, beginning at a stake in the southern line of Roberts Street, a corner to Lot No. 39 of said Addition and running thence with the eastern line of said Lot No. 39, S. 29 deg. 22′ W. 155.00 feet to a point in said line; thence a line crossing said Lot No. 38, about S. 83 deg. 30′ E. 168.00 feet, more or less, to a point in the western line of Lot No. 37 of said Addition; thence with the western line of said Lot No. 37, N. 12 deg. 16′ W. 130.00 feet to a point in said line of Roberts Street; thence with said line of Roberts Street, upon a curve to the right having a radius of 280 feet for a distance of 68.42 feet to the place of beginning.

PARCEL TWO: All the following described real estate situate in Marion County, West Virginia, in Section One of Greater Fairmont Investment Company’s Homewood Addition in Union District, a map or plat of which said Addition is of record in the Office of the Clerk of the County Court (Commission) of Marion County, West Virginia, in Deed Book No. 247, at Page 402, that is to say, Lot No. 39 in said Addition, which is more particularly bounded and described as follows:

BEGINNING at a stake on the Southwesterly side of Roberts Street, a corner to Lot No. 40; thence with the line of said Lot No. 40, S. 29 deg. 22′ W. 160.08 feet; thence S. 60 deg. 38′ E. 60.00 feet to a stake, a corner to Lot No. 38; thence with the line of said Lot No. 38, N. 29 deg. 22′ E. 160.08 feet to a stake in the line of said Roberts Street; thence with the line of said Roberts Street, N. 60 deg. 38′ W. 60.00 feet to the place of beginning.

At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 220 Roberts Street, Fairmont, WV 26554.

AND BEING the same real estate which was conveyed to Colyn J. Jones and Anita C. Jones, by Deed dated April 24, 2003, from Eula Mae Hamrick, by Nancy Schmuck, her Attorney-in-Fact, and recorded in the Office of the Clerk of the County Commission of Marion County, West Virginia, in Deed Book 984, at Page 757; AND FURTHER BEING the same real estate which was conveyed to Colyn J. Jones, by Deed dated May 27, 2005, from Anita C. Johnson (formerly Anita C. Jones), and recorded in Deed Book 1003, at Page 977.

The above-described property will be sold subject to any covenants, restrictions, easements, leases and conditions of record, and subject to any unpaid real estate taxes.

The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.

TERMS: Ten percent (10{4ceb532c6f579389df471c6c1e832caf2346b74dc60fcbf6aabd4d29df3baf9c}) of the purchase price as a cash deposit with the balance due and payable within 30 days of the day of sale.
