NOTICE OF TRUSTEE’S SALE

NOTICE OF TRUSTEE’S SALE is hereby given pursuant to and by virtue of the authority vested in the Substitute Trustee, WV Trustee Services, LLC, by that certain Deed of Trust dated May 19, 2017, executed by Borrower(s), Erin King and Russell King, to Sanders Austin & Flanigan, the Trustee of record in the office of the Clerk of the County Commission of Mercer County, West Virginia, in Book 1336, at Page 117. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 912 Front Street, Princeton, WV 24740. WV Trustee Services, LLC were appointed as Substitute Trustees by APPOINTMENT OF SUCCESSOR TRUSTEE dated August 6, 2019, of record in the Clerk’s Office in Book 1376, Page 750. The borrower(s) defaulted under the Note and Deed of Trust and the Substitute Trustees have been instructed to foreclose under the Deed of Trust. Accordingly, the Substitute Trustees will sell the following described property to the highest bidder at the front door of the Courthouse of Mercer County, in Princeton, West Virginia, on the following date:

at 11:15 a.m.

All of those certain lots or parcels of real estate designated as Parts of Lots 27 and 28, and all of Lot 29, Section 1 (City Section 141), Park Avenue Land Association Addition to the City of Princeton, Mercer County, West Virginia, and more fully bounded and described as follows: TRACT ONE – Parts of Lots 27 and 28: “Beginning in the north line of Front Street at a point 142.8 feet Easterly from the intersection of said Street line with the east line of Park Avenue on a corner between Lots No. 28 and 29 (said Lot No. 29 being known as the P. C. Twohig lot; thence S. 63 degrees 32` W. with the north line of Front Street Sixty (60) feet to a stake; thence leaving said Front Street and running in a Northerly course the distance of Eighty-two (82) feet to a stake at a point 47.5 feet distant from the west line of said Twohig lot; thence N. 63 degrees 32` E. Fourteen (14) feet to a stake; thence a Northerly course about Ninety-two (92) feet to the south line of a 20 feet wide alley, at a point 70 feet Easterly from the intersection of said alley line with the east line of Park Avenue; thence an Easterly course with the south line of said alley Twenty-three and Three Tenths (23.3) feet to a corner of the said Twohig lot; thence a Southerly course and with the dividing line between said Lots No. 28 and 29 the distance of One Hundred Seventy-Three and Two Tenths (173.2) feet to the beginning, being a part of Lots Numbered 27 and 28 of Section No. 1 shown on a Map of the Park Avenue Land Association`s Addition to the City of Princeton; recorded in Mercer County Court Clerk`s Office in Map Book No. 1, Page 104.” “There is also included in this grant and hereby granted and conveyed the right over the lot adjacent to the property herein conveyed to the east line of Park Avenue, for the City Water and Kitchen Sewer line, as at present located and used.” TRACT TWO – Lot 29: “All of that certain lot or parcel of land lying on the north side of Front Street in the City of Princeton, Mercer County, West Virginia, known and designated as Lot No. 29, of Section No. 1, of the lands of the Park Avenue Land Association, as shown by a map thereof recorded in the Office of the Clerk of the County Court of Mercer County, West Virginia, in Map Book No. 1, at Page 104. Said Lot No. 29 fronts 50 feet on said Front Street and extends back therefrom in a Northern direction, between parallel lines, 173.2 feet to an alley.

Being the same property conveyed to Erin King and Russell King by the Deed dated 05/19/2017 and recorded in Deed Book 1054 at Page 95 in the Office of the Clerk of the County Commission of Mercer County, West Virginia.

TERMS OF SALE:

1) The property will be conveyed in an “AS IS” physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the Clerk’s office or affecting the subject property.

2) The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code 11-22-1.

3) The Beneficiary and/or the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale.

4) The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee.

5) The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY.

6) The total purchase price is payable to the Trustee within thirty (30) days of the date of sale, with ten (10{4ceb532c6f579389df471c6c1e832caf2346b74dc60fcbf6aabd4d29df3baf9c}) of the total purchase price payable to the Trustee at sale.
