NOTICE OF TRUSTEE’S SALE

NOTICE IS HEREBY GIVEN that by virtue of that certain Deed of Trust dated July 9, 2008, executed by KP Foodmart Inc., a West Virginia Corporation, to Thomas S. Lilly, Trustee, of record in the Office of the Clerk of the County Commission of Mercer County, West Virginia, in Trust Deed Book 1146, at page 610, David M. Kersey having been substituted as Trustee pursuant to Notice of Appointment of Successor Trustee, dated July 20, 2018, of record in the aforesaid Clerk’s office in Trust Deed Book 1358, at page 251, default having occurred in payment of the indebtedness secured by said deed of trust, and the undersigned successor trustee having been requested to do so by Hanmi Bank, successor by merger to United Central Bank, owner and holder of the indebtedness secured by said deed of trust, the undersigned successor trustee will offer for sale and sell at public auction on July 19, 2019, at 10:00 a.m., at the north entrance to the Mercer County Courthouse, 1501 Main Street, Princeton, Mercer County, West Virginia, the following described real estate, together with the improvements thereon and appurtenances thereunto belonging, more particularly bounded and described as follows:

All that certain lot or parcel of land situate in the County of Mercer, State of West Virginia, and being more particularly described as follows:
“All of those certain improved lots or parcels of real estate situate in the City of Princeton, Mercer County, West Virginia, being Lots 5,6, 7 and Part Lot 8, Section 12, Rogers Street, shown upon a map recorded as Microplat No. 10435, also shown upon the Mercer County Assessor’s Tax Map for the City of Princeton on Map 16 as Parcel 249”, and being more particularly bounded and described as follows:

“BEGINNING at a point in the south line of Rogers Street, N. 74 41′ E. 100.0 feet from the point of intersection of the south line of Rogers Street with the east line of Locust Avenue (formerly Sanders Avenue); thence from said beginning point along and with the south line of Rogers Street, N. 74 41′ E. 130.0 feet to an iron pin, the common northern corner of Lots 4 and 5; thence with the dividing line between Lots 4 and 5, S. 15 19′ E. 125.0 feet to a point in the north line of a 12-feet wide alley, the common southern corner of Lots 4 and 5; thence along and with the north line of said alley, S. 74 41′ W. 130.0 feet to a point; thence through Lot 8 N. 15 19′ W. 125.0 feet to the point of BEGINNING, containing 18,750 square feet, more or less.”

“This conveyance is further subject to an easement for a water line serving a building situate on Lots 10, 9 and Part Lot 8, Section 12 (Map 16, Parcel 248).”

“This conveyance is subject to all easements, restrictions and reservations of record affecting the real estate herein conveyed.”

“Pursuant to W.V. Code 22-17-19, the Grantor declares that the property contains underground storage tanks for the storage and dispensing of petroleum products.”

TERMS OF SALE: Ten percent (10{4ceb532c6f579389df471c6c1e832caf2346b74dc60fcbf6aabd4d29df3baf9c}) cash in hand on day of sale and balance upon delivery of deed. Sale subject to any and all liens recorded or otherwise, real property taxes or assessments due or to become due, all applicable subdivision and zoning restrictions, matters of survey, compliance with environmental regulations, rights of tenants in possession, if any, and all other pertinent liens, easements, restrictions and reservations of record. The property is sold in an “as is” condition. The purchaser shall pay the excise tax on the transfer of real estate. Any personal property remaining on the premises at the time of sale shall be considered abandoned. The undersigned trustee reserves the right to reject any and all bids, the right to continue the sale by announcement on the date of the sale and the right to announce other conditions upon the sale, which announced conditions, if any, shall be in addition to or take priority over any conditions set forth herein.
