NOTICE OF TRUSTEE’S SALE

Under authority of that certain Deed of Trust dated May 19, 2008, from Dennis P. Lansberry Jr. and Sherry L. Lansberry, husband and wife, to Casie McGee, Trustee, of record in the office of the Clerk of the County Commission of Marion County, West Virginia in Trust Deed Book No. 930, at page 745, securing a promissory note in the principal amount of $106,339.54, payable to Vanderbilt Mortgage and Finance, Inc., and default having been made pursuant to the promissory note secured by the aforesaid Deed of Trust and sale requested by Vanderbilt Mortgage and Finance, Inc., the undersigned Substitute Trustee will offer for sale at the front door of the Marion County Courthouse in Fairmont, West Virginia on January 14, 2015 at 10:00 a.m., subject to all reservations, exceptions, easements and other matters which appear of record and subject to all unpaid taxes, if any, all those certain lots or parcels of real estate, together with the buildings and other improvements thereon, and all the appurtenances and privileges thereunto in any manner belonging, situate, lying and being in the Union District, Marion County, West Virginia, located off State Route 310 along the eastern side of a private road and more particularly bounded and described as follows:

LOT NUMBER TEN (10), beginning at a 1/2 inch x 30 inch iron rod (set) in the eastern line of a private road and a corner to Lot # 9; thence with the line of Lot # 9, S. 82 degrees 00’ 06” E. 482.66 feet to a 1/2 inch x 30 inch iron rod (set) in the line of (now or formerly) Satterfield; thence with the line of (now or formerly) Satterfield S. 8 degrees 06’ 08” W. 174.81 feet to a 1/2 inch x 30 inch iron rod (set) in the line of (now or formerly) Satterfield corner to Lot # 11; thence with the line of Lot # 11, N. 81 degrees 53’ 55” W. 500.78 feet to a 1/2 inch x 30 inch rod (set) in the eastern line of a private road; thence with two eastern lines of said road, N. 8 degrees 37’ 08” E. 94.28 feet to a 1/2 inch x 30 inch rod (set); thence N . 20 degrees 20’ 12” E. 81.52 feet to a 1/2 x 30 inch iron rod (set) to the place of beginning, containing 1.986 acres as surveyed by Gary A. Timms, Professional Surveyor # 877SU of Fairmont, West Virginia and shown on a plat of survey.  The meridian for all bearings in this description is based on the Deed 804/1515 dated August 1, 1977.

Together with a non-exclusive Deed of Easement and Right of Way for ingress and egress and regress over and across a private road, upon the lands of Scott A. Kreps and Brenda L. Kreps which Deed of Easement and Right of Way was granted to Vincent James Nash and Frances Irene Nash, husband and wife, on September 30, 2006.  Said Deed of Easement and Right of Way is of record in the office of the Clerk of the County Commission of Marion County West Virginia in Deed Book Number 1018 at page 460.

This Deed of Easement and Right of Way is for ingress and egress only and the Grantees covenant and agree that they will maintain same, together with the Grantors, and all other holders of Right(s) of Way upon said private road, and their successors and assigns in respective shares and apportioned based on the length of each such Right of Way.

Being the same property conveyed from Vincent James Nash and Frances Irene Nash, husband and wife to Dennis P. Lansberry Jr. and Sherry L. Lansberry, husband and wife, by Deed dated April 14, 2008, of record in the aforesaid Clerk’s office in Deed Book No. 1037, at page 235.

Terms of the sale: cash on date of sale.
