NOTICE OF TRUSTEE’S SALE
NOTICE is hereby given that default having been made under the terms of a construction loan deed of trust dated February 16, 2023, and of record in the Office of the Clerk of the County Commission of Raleigh County, West Virginia, in Book 5079, at page 1856 and executed by James White to Clyde A. Smith, Jr., Trustee, securing Marenatha, LLC, which was given to secure the payment of the note therein described, and the performance of the covenants therein and in the JOINT VENTURE AGREEMENT dated July 7, 2022, and demand having been made upon the undersigned so to do, the undersigned Trustee, Clyde A. Smith, Jr. will, on the 10th day of June, 2024, at the front door of the Raleigh County Courthouse, in the City of Beckley, West Virginia, at 10:00 a.m., sell the property hereinafter described, which property was conveyed in said deed of trust, and being more particularly described as follows:
The surface of Lot 10, Block 4, Kingsglade Subdivision, Glade Springs Village, Shady Spring District, Raleigh County, West Virginia.
And being the same property conveyed to James White from Jeyeco, LLC, a West Virginia Limited Liability Company, by Deed dated the 8th day of June, 2022, recorded in the Office. of the Clerk of the County Commission of Raleigh County, West Virginia, in Deed book 5076, at Page 5510.
Said sale will be made upon the following terms and conditions:
1. 10% Cash in hand on day of sale with final settlement within 30 days of sale.
2. Subject to all unpaid real property taxes against said real estate, and to any liens for sewer charges assessed by any public service district, or municipality.
3. Subject to all mineral and mining rights and reservations, all stipulations, restrictions, reservations, easements, conditions and covenants contained in all former conveyances of the subject property, except any pertaining to race, color or creed.
4. The aforesaid sale may be adjourned from time to time as the undersigned Trustee deems advisable or as the beneficial Holder shall direct.
5. Notice is hereby given that there has been partial construction of a ~ residence on the property which has not been completed. Any purchaser of said property will be required to complete the construction according to the covenants, rules and regulations of the Glade Springs Village Property Owners Association and the Architectural Control Committee.
6. Subject to the right of redemption of the Internal Revenue Service.
7. Purchaser shall be responsible for any stamp tax and recording fees for the deed.
