NOTICE OF SPECIAL
COMMISSIONER’S JUDICIAL
SALE OF VALUABLE
REAL ESTATE

Notice is hereby given that the undersigned, MORGAN SPOLARICH, SPECIAL COMMISSIONER, by virtue of that certain Order entered the 8th day of April, 2024, in that certain Civil Action now pending before the Circuit Court of Raleigh County, West Virginia, styled, Brenda K. Belcher-Adkins v. Johnny Belcher, Paula Belcher, Telietha Smith, Paul Pelfrey Et Al, Civil Action No. 2023-C-226, the said Court having directed the Special Commissioner to make sale of the real estate that is the subject of said Civil Action, the undersigned Special Commissioner will offer for sale and sell at public auction to the highest bidder on the July 18, 2024 at 1:30 p.m., at the front door of the Raleigh County Courthouse in the Town of Beckley, Raleigh County, West Virginia, the real estate or premises that is the subject of said Civil Action being and consisting of the following located in Big White Stick Creek, Town District, Raleigh County, West Virginia, and more particularly described as follows:

FIRST: Beginning at a steel shaft planted in the ground on the North side of the road leading from State Highway No. 3, to Chester Stanley’s place, and on the East side of Big White Stick Creek; thence crossing the said creek, S 73 degrees 55’ W 168.0 feet to a locust fence post; N 5 43’ W 96.0 feet to a fence post; N 71 degrees 16’ E 157.5 feet to a stake in East edge of Big White Stick Creek; S 11 degrees 58’ E 96.0 feet to the beginning, containing 0.358 of an acre.

SECOND: Beginning at a locust fence post on the North side of the road leading from State Road No. 3, to Chester Stanley residence; a corner to the lot above described; thence with lines of said lot N 5 degrees 43’ W 96.0 feet to a fence post; thence N 71 degrees 16’ E 157.5 feet to a stake on East Bank of Big White Stick Creek; thence leaving lines of above mentioned lot and running with lands of H. F. and Jennie Harper, N 11 degrees 18’ W 1.0 feet to a stake on the West Bank of Big White Stick Creek; thence S 71 degrees 16’ W 317.5 feet to a stake by a wire fence; thence with said fence S 12 degrees 05’ E 105.5 feet to a fence post in North right-of-way line of road leading to Chester Stanley residence; thence with said right-of-way line N 73 degrees 55’ E 154.5 feet to the beginning, containing 0.43 acres.

AND BEING the same property Freda Haymire acquired from Grace Belcher by deed dated May 26, 1987 and recorded in the aforesaid Office of the Clerk of the County Commission of Raleigh County, West Virginia in Deed Book 721 at Page 820.
The sale is subject to and conditioned upon confirmation by the Circuit Court of Raleigh County.
Title shall be conveyed by the Special Commissioners with covenants of special warranty. The property taxes will be paid through the 2023 tax year. All taxes thereafter assessed against the said property shall be paid by the Purchaser. The aforesaid sale may be adjourned from time to time as the undersigned Special Commissioner deems advisable, which adjournment may be made by oral proclamation at the time and place of the sale or any adjournment thereof. The subject property will be sold in AS IS condition. The Special Commissioner shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.
TERMS OF SALE: 10% cash in hand on day of sale, balance due at closing which shall occur within 30 days of confirmation of the sale by the Circuit Court of Raleigh County. In the event that the Purchaser fails to consummate the transaction, the 10% down shall be forfeited.
