NOTICE OF SALE BY
PUBLIC AUCTION
The State of West Virginia, by Anthony Ciliberti, Jr., Prosecuting Attorney, Fayette County, West Virginia, on behalf of the Central Regional Drug and Violent Crime Task Force and Oak Hill Police Department, by virtue of the authority of the Order of Default Judgment, entered on the 5th day of October, 2023, of record in the Fayette County Circuit Clerk’s Office, pursuant to Chapter 60A, Article 7, Section 707 of the West Virginia Code, as amended, will offer for sale at public auction on the front steps of the Fayette County Courthouse, 100 Court Street, Fayetteville, West Virginia, on Tuesday, June 25, 2024, at 12:00 noon, the following described real estate, together with its improvements, easements and appurtenances thereunto belonging, situate in the City of Oak Hill, Fayette County, West Virginia, as recorded in the Fayette County Clerk’s office in Deed Book 545, Page 308.
At the time of Final Order, this property was reported to have an address of 108 Noble Street, Oak Hill, West Virginia 25901.
An “Open House” will be held at the subject property Monday, June 24, 2024, from 12:00 noon to 4:00 p.m.
The referenced real estate will be conveyed with no covenants of warranty and subject to all covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk’s office or visible upon the ground, all prior liens and encumbrances, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges. The purchasers at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property (the cost of the tax stamp to be affixed to the deed.) The purchasers shall be responsible for payment of all real estate taxes.
The subject property will be sold in “AS IS” condition. Neither, the Prosecuting Attorney, the Central Regional Drug and Violent Crime Task Force or the Oak Hill Police Department, shall be under any duty to cause any existing tenant or person occupying the subject property to vacate said property.
TERMS: Five Thousand Dollars ($5,000.00) in cash and/or certified funds as deposit with the balance due and payable within thirty (30) days of sale. Minimum reserve bid amount exists and Seller reserves the right to refuse bids below reserve amount.
FEDERAL TAX LIEN: In the event there are Federal tax liens against the property, the United States would have the right to redeem the property within a period of one hundred twenty (120) days from the date of such sale or the period allowable for redemption under local law, whichever is longer.
The Prosecuting Attorney and/or the Central Regional Drug and Violent Crime Task Force and/or the Oak Hill Police Department has the right to postpone the sale by public announcement at the time and place designated or by posting a notice of the same, and act by agent in the execution of the sale. The Prosecuting Attorney and/or the Central West Virginia Drug Task Force and/or the Oak Hill Police Department reserve the right to refuse bids. The Prosecuting Attorney, the Central Regional Drug and Violent Crime Task Force and the Oak Hill Police Department reserve the right to purchase the property at such sale.
