NOTICE OF TRUSTEE’S SALE is hereby given pursuant to and by virtue of the authority vested in the Substitute Trustee, WV Trustee Services, LLC, by that certain Deed of Trust dated July 30, 2008, executed by Borrower, Robert W Calvert, to Carl W. Roop, the Trustee of record in the office of the Clerk of the County Commission of Fayette County, West Virginia, in Book 826, at Page 558. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 414 Hugart Rd House 1, Danese, WV 25831. WV Trustee Services, LLC were appointed as Substitute Trustees by APPOINTMENT OF SUCCESSOR TRUSTEE dated November 21, 2023, of record in the Clerk’s Office in Book 1090, Page 435. The borrower defaulted under the Note and Deed of Trust and the Substitute Trustees have been instructed to foreclose under the Deed of Trust. Accordingly, the Substitute Trustees will sell the following described property to the highest bidder at the front door of the Courthouse of Fayette County, in Fayetteville, West Virginia, on the following date:

15th day of July, 2024
at 11:15 a.m.

BEGINNING at a ½ inch rebar with a cap (set) on a fence line on the northwest side of a 30 foot easement and on the line of the Garnet and Linda S. Campbell tract, from which a 1/2 rebar (found) corner to the same bears N 21-04`-09” E 521.35 feet, thence with the Campbell tract; S 21-04`-09” W 305.00 feet to a 1/2 inch rebar with a cap (set) 5 feet west of a fence line, corner to the Alan and Linda Roberts tract and on the line of the Harold H. & Kathy J. McQuire tract, from which a rebar corner bears S 21-04`-09” W 660.90 feet, thence through the Roberts tract, which this tract is a part of, for four (4) calls, N 78-11`-14” W 667.45 feet to a inch rebar with a cap (set) on a flat bench near the toe of an old strip high wall slope, thence N 10-34`-20” W 215.32 feet to a ½ inch rebar with a cap (set) on north edge of a strip bench, from which a 1/2 inch rebar corner (found) bears S 66-53`-22 W 347.78 feet, and a 17 inch White Pine bears N 37-30` E 20.0 feet, thence N 82-19-28” E 395.15 feet to a ½ inch rebar with a cap (set) on the north edge of a strip bench, thence S 74-10`-23” E 427.05 feet to beginning, containing 5.00 acres, more or less, as surveyed in January, 2002, by Marathan Technical Services, Inc., Summersville, WV. And being the same property conveyed unto the party of the first part herein by deed of Linda Calvert, dated the 20th day of April, 2007, and recorded in the Office of the Clerk of the County Commission of Fayette County, West Virginia, in Deed Book 629, at Page 594. The party of the first part further grants unto the party of the second part that certain right of way and easement for ingress and egress and waterline easement, as set forth in that Right of Way Deed by and between Garnet Campbell, et ux, and Linda Roberts, et vir, dated the 25th day of February, 2002, and recorded in the aforesaid Clerk`s Office in Deed Book in Deed Book 584, at Page 119.

Being the same property conveyed to Robert W Calvert by the Deed dated July 25, 2006 and recorded in Deed Book 623 at Page 187 in the Office of the Clerk of the County Commission of Fayette County, West Virginia.


1) The property will be conveyed in an “AS IS” physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the Clerk’s office or affecting the subject property.

2) The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code § 11-22-1.

3) The Beneficiary and/or the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale.

4) The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee.

5) The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY.

6) The total purchase price is payable to the Trustee within thirty (30) days of the date of sale, with ten (10%) of the total purchase price payable to the Trustee at sale.
