The application is on file with the Virginia Department of Energy identifying the proposed location and all work to be performed at the described site. Any inquiries should be directed to the Gas and Oil Team at 276 415-9700.

Code of Virginia Section 45.2-1632 identifies persons with rights to file objections to the gas and oil operation. Persons objecting to a permit must state their reasons for objecting within 15 days of the date of receipt of notice. Written objections must be filed with the Virginia Department of Energy, Gas and Oil Director, 3405 Mountain Empire Road, Big Stone Gap, VA 24219.

The object of the above-entitled action is to quiet title certain real property located in Marion County, West Virginia, being more specifically described as a portion of Charles Street, as shown highlighted in yellow on the survey attached to the Complaint as Exhibit 1, and as further described below (hereinafter, the “Subject Tract”), and additional requested relief, as is more particularly described in the Complaint filed herein.
The part of Charles Street relevant to this Civil Action was declared abandoned by the City of Fairmont, West Virginia, on September 11, 1990 (hereafter, the “Abandoned Section of Charles Street”). The legal description for the Abandoned Section of Charles Street, which includes the Subject Tract, is set forth and described in Ordinance 849, which is attached to the Complaint as Exhibit 3.
It appearing by Affidavit filed in this action that the Plaintiffs have attempted to obtain service of the Complaint upon Defendants, Rebecca Carmella Bonnette, Brenda Jo Cress, Michael A. Sauro, Stanis Sauro Lindsey, Debra Sauro Wagner, Jason Christopher Sauro, Robert Lee Sauro, Betty Ann Schindele, Randy Sauro, Dennis Bartlett, Pamela Gaziano, Gabriel D. Chadwick, Nicole D. Thompson, Stephanie E. Young, Beverly Orr Synnestvedt, Berkley C. Orr, Suzanne S. Kline, Helen Sauro Perrella, Diana Sauro Gump, Rosalie Sauro Drazba, Louise Sauro, Michael T. Pellegrin, John D. Pellegrin, Jenny A. Camele, Joseph A. Pellegrin, John Alfred Sauro, Janet Lynn Michalski, The Anthony M. Sauro Revocable Trust, and all other Unknown or Unlocatable Heirs, Successors and/or Assigns of Veto Sauro, Larry F. Sauro, Anthony Wayne Sauro, Michael Sauro, Pete Sauro, Mary Bartimocca Bartlett, Angeline Sauro Orr, Boyd Dan Orr, and Louise Sauro, (collectively “the Sauro Defendants”), by certified mail, and that the Plaintiffs have used due diligence pursuant to Rule 4(e)(1)(C) of the West Virginia rules of Civil Procedure, to ascertain the addresses or whereabouts of the Sauro Defendants.
