The undersigned Substitute Trustee, by virtue of the authority vested in it by that certain Deed of Trust dated February 28, 2019, and duly recorded in the Office of the Clerk of the County Commission of Fayette County, West Virginia, in Deed of Trust Book 1009, at Page 649, Ruth Overton did convey unto Robert H. Skeen, Jr., Trustee, certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Pill & Pill, PLLC as Substitute Trustee by a Substitution of Trustee recorded in the aforesaid Clerk’s Office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by the secured party to foreclose thereunder, will offer for sale at public auction at the front door of the Fayette County Courthouse, in Fayetteville, West Virginia, on

The following described real estate, with its improvements, easements and appurtenances thereunto belonging, situate in the Valley District, Fayette County, West Virginia, and more particularly described as follows:
Situated in the Village of Powellton, Kanawha District of Fayette County, West Virginia, and more particularly bounded and described as follows, to-wit:
PARCEL ONE:
BEGINNING at a steel rail on the west side of road bearing N 63-14 W 415.74 feet from a steel rail being 2.3 feet from corner of warehouse and 20.0 feet east of creek bank parallel with the road S 42-50 E 138.17 feet to a steel rail, thence S 47-41 W 153.44 feet to a steel rail on the hillside, thence with the hillside N 34-39 W 166.91 feet to a steel rail, thence down the hill N 59-27 E 132.66 feet, to the beginning, containing 0.498 acres.
PARCEL TWO:
BEGINNING at a steel rail on the east side of road bearing N 75-55 E 42.45 feet, from the beginning corner or Parcel No. 1, with the east side of road N 11-49 E 32.42 feet to a steel rail on the west bank of creek, thence with the west bank of creek S 56-26 E 78.48 feet to a steel rail, thence S 44-38 E 307.62 feet to a steel rail 3.0 feet from west bank of creek; thence leaving bank of creek S 48-52 W 66.21 feet to a steel rail on the east side of road; thence with the east side of road N 42-52 W 359.21 feet, to the beginning, containing 0.492 acres.
There is specifically excepted and reserved from the operation of this conveyance all of the coal and other minerals lying on, in and under the lands herewith conveyed, together with the free and uninterrupted right to mine and remove the same, provided, however, that such removal shall not materially interfere with the proper use of the property by the grantee herein.
SAVING AND EXCEPTING an out conveyance recorded in Deed Book 461, Page 210, dated April 21, 1988.
At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 4428 Armstrong Creek Drive, Powellton, WV 25161.
AND BEING the same real estate which was conveyed to Ruth Overton, by Deed dated January 14, 2019, from Karen L. Pierce, Allen W. Price and Daniel Eric Price, and recorded in the Office of the Clerk of the County Commission of Fayette County, West Virginia, in Deed Book 773, at Page 507. A Deed of Correction was recorded in Deed Book 774, at Page 598.
The above-described property will be sold subject to any covenants, restrictions, easements, leases and conditions of record, and subject to any unpaid real estate taxes.
The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.
