The undersigned Substitute Trustee, by virtue of the authority vested in him by that certain Deed of Trust, dated July 20, 2007, and duly recorded in the Office of the Clerk of the County Commission of Raleigh County, West Virginia, in Document No. 50278559, in Book No. 5027, at Page 8559, Shannon R McPeake did convey unto Richard A. Pill, Esq., Trustee(s), certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Seneca Trustees, Inc., as Substitute Trustee by a Substitution of Trustee dated January 7, 2021, and recorded in the aforesaid Clerk’s office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by Federal Home Loan Mortgage Corporation, as Trustee for the benefit of the Seasoned Credit Risk Transfer Trust, Series 2018-1 to foreclose thereunder, will offer for sale at public auction at the front door of the Raleigh County Courthouse in Beckley, West Virginia, on
March 1, 2021 at 1:15 PM
the following described real estate, together with its improvements, easements and appurtenances thereunto belonging, situate in Raleigh County, West Virginia, and more particularly described as follows:
The surface of those certain lots or parcels of land, together with the improvements thereon and the appurtenances thereunto belonging, situate in the City of Beckley, Raleigh County, West Virginia, and more particularly described as follows:
TRACT I:
Beginning at a point in south line of Mason Street, (formerly called B Street and at one time a ten foot alley), a common corner to this lot and Warden lot, formerly R. L. Maxwell lot; thence with line of said lots about S. 3 40′ W. 135 feet to a stake, another common corner of this lot and said Warden lot in line of lot formerly owned by B. E. Carter, thence with the line of same S. 85 30′ W. 61 feet to a stake, a common corner to this lot and a lot formerly owned by S. S. Sutphin, thence with line of said Sutphin lot and lot formerly owned by Lillie B. Watts, about N. 5 W. 132 feet to a stake in said south line of Mason Street, a common corner to this lot and said lots formerly owned by Lillie B. Watts, thence with said south line of Mason Street N. 85 E. 64 feet to the place of beginning.
TRACT II:
A strip of surface land from the eastern end of the residence lot of A. D. Preston, conveyed to Sarah Elizabeth Young and O. C. Young, her husband, by deed dated the 4th day of December, 1928, and recorded in said Clerk’s Office in Deed Book No. 102, at page 217, adjoining above described first lot and described in said deed as follows:
Beginning at northeast corner of said lot on line between said Preston and said Young on the south side of said Mason Street; thence with the south line of said Mason Street westwardly ten feet to a stake this day set, thence at right angles to said Mason Street in a southerly direction a straight line to the rear line of said Preston lot; thence eastwardly with said line to the line of said Young, thence with said Young line northerly to the point of beginning.
TRACT III:
The surface of that certain parcel of land located on the back end of the Watts property, on the east side of North Kanawha Street, and being a strip of land ten feet wide and fifty feet long, and being more particularly bounded and described as follows:
Beginning at a stake located at a distance of 66.50 feet south of Mason Street and also on the western line of Luchini’s property; thence, westerly 10 feet to a stake on the R. D. Watts property; thence, along the eastern boundary of the R. D. Watts lot a distance of 50 feet to a stake; thence, at right angle 10 feet to a stake on the Luchini’s line; thence, northerly along Luchini’s line 50 feet to the point of beginning.
And being the same property acquired by Shannon R. McPeake by deed dated July 12, 2007 from Citimortgage, Inc., to be recorded in the Office of the Clerk of the County Commission of Raleigh County, West Virginia, prior to or simultaneously herewith.
At the time of the execution of the Deed of Trust, this property was reported to have an address of: 110 Mason Street, Beckley, WV 25801.
The referenced real estate will be conveyed with no covenants of warranty, and subject to all covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk’s Office or visible upon the ground, all prior liens and encumbrances, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges. The purchasers at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property (the cost of the tax stamp to be affixed to the deed). The purchasers shall be responsible for payment of all real estate taxes.
The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.
TERMS: $3500.00 in cash and/or certified funds as deposit at the time of sale with the balance due and payable within 30 days of the day of sale.
FEDERAL TAX LIEN: In the event that there are Federal Tax Liens against the property, the United States would have the right to redeem the property within a period of 120 days from the date of such sale or the period allowable for redemption under local law, whichever is longer.
Pursuant to the Deed of Trust, the Trustee may postpone the sale by public announcement at the time and place designated or by posting a notice of the same, and act by agent in the execution of the sale. The parties secured by the Deed of Trust reserve the right to purchase the property at such sale.
