TRUSTEE’S SALE OF
VALUABLE REAL ESTATE

The undersigned Substitute Trustee, by virtue of the authority vested in it by that certain Deed of Trust dated February 18, 2022, and duly recorded in the Office of the Clerk of the County Commission of Marion County, West Virginia, in Deed of Trust Book 1296, at Page 633, Justin Vincent did convey unto Sansalone & Sansalone, Trustee, certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Pill & Pill, PLLC as Substitute Trustee by a Substitution of Trustee recorded in the aforesaid Clerk’s Office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by the secured party to foreclose thereunder, will offer for sale at public auction at the front door of the Marion County Courthouse, in Fairmont, West Virginia, on

November 12, 2024, at 4:04 PM

The following described real estate, with its improvements, easements and appurtenances thereunto belonging, situate in the Union District, Marion County, West Virginia, and more particularly described as follows:

All of that certain lot or parcel of real estate situate in the Village of Colfax, Union District, Marion County, West Virginia, depicted on that certain plat prepared by Paul D. Harbert PS No. 862, dated September 2012, entitled “Plat of 0.60 Acres Located at 1743 Colfax Road, Surveyed for Benjamin C. and Heather E. Wilson” and of record in the Office of the Clerk of the County Commission of Marion County, West Virginia in Deed Book No. 1122, at page 318, and to which reference is hereby made for a more particularly description, and which is defined by metes and bounds as follows:

Beginning at a 5” metal monument found on the northern right of way limits of Colfax Road, corner to Shirley Kirk; thence with the northern right of way limits of Colfax Road N. 65° 24’ 14” W. 184.23 feet to a 5/8” iron pin set on the northeastern right of way limits of Colfax Road and School Street; thence with the eastern right of way limits of School Street, N. 22° 21’ 30” E. 133.13 feet to a 5/8” iron pin set on the eastern right of way limits of School Street, corner to Joseph Esultante; thence with line of Joseph Esultante (D.B. 803, page 271), S. 68° 37’ 15” E. 194.82 feet to a 5” metal monument found in line of Joseph Esultante, corner to Shirley Kirk; thence with line of Shirley Kirk (D.B. 986, page 967), S. 26° 36’ 59” W. 144.06 feet to the place of beginning containing 0.60 acres.

Being the same real estate conveyed unto Justin Vincent, also known as Justin C. Vincent from Benjamin C. Wilson and Heather Wilson, husband and wife, by deed dated February 17, 2022, and to be recorded simultaneously herewith.

This conveyance is specifically made subject to all reservations, agreements, exceptions, land use regulations, covenants, conditions, rights-of-way, restrictions, prior conveyances or mineral severances and rights to extract the same, easements, limitations of use as have been imposed upon such property by the GRANTORS and their predecessors in title, and those shown on all recorded plats or maps of survey, including the subdivision maps of record and/or contained in instruments in the chain of title to the extent that the same remain in force and effect.

At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 1743 Colfax Road, Fairmont, WV 26554.

AND BEING the same real estate which was conveyed to Justin Vincent, by Deed dated February 17, 2022, from Benjamin C. Wilson and Heather E. Wilson, and recorded in the Office of the Clerk of the County Commission of Marion County, West Virginia, in Deed Book 1296, at Page 49.

The above-described property will be sold subject to any covenants, restrictions, easements, leases and conditions of record, and subject to any unpaid real estate taxes.

The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.

TERMS: Ten percent (10%) of the purchase price as a deposit with the balance due and payable within 30 days of the day of sale.
