TRUSTEE’S SALE OF
VALUABLE REAL ESTATE

The undersigned Substitute Trustee, by virtue of the authority vested in it by that certain Deed of Trust dated August 16, 2016, and duly recorded in the Office of the Clerk of the County Commission of Fayette County, West Virginia, in Deed of Trust Book 971, at Page 647, David R. Smith did convey unto Teays Valley Trustee LLC, Trustee, certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Pill & Pill, PLLC as Substitute Trustee by a Substitution of Trustee recorded in the aforesaid Clerk’s Office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by the secured party to foreclose thereunder, will offer for sale at public auction at the front door of the Fayette County Courthouse, in Fayetteville, West Virginia, on

November 19, 2024, at 2:15 PM

The following described real estate, with its improvements, easements and appurtenances thereunto belonging, situate in the New Haven District, Fayette County, West Virginia, and more particularly described as follows:

All the following described tract or parcel of real estate together with any improvements thereon, rights incidental thereto and any appurtenances thereunto belonging situate on WV Route 41, in Landisburg, New Haven District, Fayette County, west Virginia and being more particularly bounded and described as follows, to wit:

Beginning at an old cherry stump with fence post corner to Tolley and Ward’ 1. Thence N 00° 20’ 57” W 113.86 feet to a small cherry tree with old fence post; thence S. 89° 49’ 51” W 135.37 feet to a 5/8” rebar (set); thence S. 05° 19’ 02” E. 20.00 feet to a 5/8” rebar (set) corner to Sevy and Tolley; thence S. 85° 06’ 24” E. 127.00 feet to the point of beginning, and containing 0.3 acres, more or less, as shown on plat entitled, “Plat of Survey for Home Loan Mortgage Corp”, prepared by G.A. Covey Engineering, and which said plat is attached to that certain right of way agreement of record in the Office of the Clerk of the County Commission of Fayette County, West Virginia, in Deed Book 635 at Page 442.

At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 22328 Stanaford Road, Danese, WV 25831.

AND BEING the same real estate which was conveyed to David R. Smith, by Deed dated November 4, 2008, from Michael R. Tolley and Rhonda A. Tolley, and recorded in the Office of the Clerk of the County Commission of Fayette County, West Virginia, in Deed Book 643, at Page 691.

The above-described property will be sold subject to any covenants, restrictions, easements, leases and conditions of record, and subject to any unpaid real estate taxes.

The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.

TERMS: Ten percent (10%) of the purchase price as a deposit with the balance due and payable within 30 days of the day of sale.
