Notice is hereby given that NICHOLAS CONTURA, LLC 1051 MAIN STREET, MILTON, WV 25541 has submitted an application to the Department of Environmental Protection (DEP), Division of Mining and Reclamation (DMR) located at 1159 Nick Rahall Greenway, Fayetteville, WV 25840 for an Article 3 permit for the additional surface disturbance of approximately 143.43 acres, for a total 435.83 acres, in order to area, contour and highwall mine Coalburg, upper, middle and lower Winifrede, Chilton, Hernshaw, Williamson, Cedar Grove, Alma, Peerless, 2 Gas, Campbells Creek, Powellton seams of coal.
This Amendment will exceed the acreage limitations of 57.4 acres (35% of the original permit area of 164 acres) by a total of 86.03 acres. The proposed operation is discharging into Town Creek, unnamed tributaries (locally know as Bee Branch and Georges Branch) of Willis Branch all of Paint Creek; unnamed tributary (locally known as Reeds Branch) and Ewing Fork of Toney Fork of Clear Fork of Kanawha River and is located 2.1 miles, west of Pax in Plateau & Clear Fork districts of Fayette & Raleigh counties, Longitude 81o 17′ 59″ Latitude 37o 55′ 18″.

Written comments and/or requests for an informal conference of the surface mining application shall identify the applicant and application number and will be received by the Permit Supervisor at the DEP address above until April 10, 2021, or thirty (30) days from date of final publication.
