The undersigned Substitute Trustee, by virtue of the authority vested in it by that certain Deed of Trust dated January 28, 2020, and duly recorded in the Office of the Clerk of the County Commission of Fayette County, West Virginia, in Deed of Trust Book 1025, at Page 219, Matthew Kyle Blake and Ashley Blake did convey unto Paul O. Clay Jr., Trustee, certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Pill & Pill, PLLC as Substitute Trustee by a Substitution of Trustee recorded in the aforesaid Clerk’s Office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by the secured party to foreclose thereunder, will offer for sale at public auction at the front door of the Fayette County Courthouse, in Fayetteville, West Virginia, on
November 19, 2024, at 2:17 PM
The following described real estate, with its improvements, easements and appurtenances thereunto belonging, situate in the Oak Hill District, Fayette County, West Virginia, and more particularly described as follows:
BEGINNING at a stake on south side of the Summerlee Road at corner to the lot set apart for the home of Anna Norosky Maynus, 139 feet from the original corner in center of an alley and running with line of said lots S 8 10 W 265 feet to corner to said lot; thence continuing with same N 79 55 W 184 feet to a stake in center of said alley, thence with the center of said alley N 19 25 E 241 feet to a stake on the south side of the said Summerlee Road; thence with the same N 87 W 0 E 139 feet to the beginning, containing 1.81 acre, more or less.
This instrument is made subject to all lawful restrictions, reservations, covenants and conditions, made and contained in prior deed in the chain of title to the above described real estate.
At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 3076 Summerlee Road, Oak Hill, WV 25901
AND BEING the same real estate which was conveyed to Matthew Kyle Blake and Ashley Blake, by Deed dated January 28, 2020, from Carol Rush West, and recorded in the Office of the Clerk of the County Commission of Fayette County, West Virginia, in Deed Book 791, at Page 162.
The above-described property will be sold subject to any covenants, restrictions, easements, leases and conditions of record, and subject to any unpaid real estate taxes.
The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.
TERMS: Ten percent (10%) of the purchase price as a deposit with the balance due and payable within 30 days of the day of sale.
