NOTICE OF TRUSTEE’S SALE
NOTICE OF TRUSTEE’S SALE is hereby given pursuant to and by virtue of the authority vested in the Substitute Trustee, WV Trustee Services, LLC, by that certain Deed of Trust dated July 11, 2017, executed by Borrower(s), William M Sutphin, to Teays Valley Trustees, LLC, the Trustee of record in the office of the Clerk of the County Commission of Fayette County, West Virginia, in Book 985, at Page 713. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 388 School House Hollow Rd, Page, WV 25152. WV Trustee Services, LLC were appointed as Substitute Trustees by APPOINTMENT OF SUCCESSOR TRUSTEE dated October 25, 2024. The borrower(s) defaulted under the Note and Deed of Trust and the Substitute Trustees have been instructed to foreclose under the Deed of Trust. Accordingly, the Substitute Trustees will sell the following described property to the highest bidder at the front door of the Courthouse of Fayette County, in Fayetteville, West Virginia, on the following date:
13th day of December, 2024 at 12:00 p. m.
The following described tracts or parcels of real estate situate in page, Fayette County, West Virginia, and being more particularly bounded and described as follows, to wit: Tract 1 Lot No. 91 in that certain plan of lots entitled “subdivision of surface tracts,” Section no. 1, page, Fayette County, West Virginia, a map of which is recorded in the office of the clerk of the county clerk of Fayette County West Virginia, in map book 11 at page 24, together with all rights and easements appurtenant thereto, including the right to use in common with the owners of the other lots, the streets, alleys and ways on said map set forth. Tract 2 Beginning at the Northwest corner of Parcel No. 1, conveyed to Everett Hannah by deed dated April 1, 1959, and recorded in the office of the clerk of the county court of Fayette County, West Virginia. In deed book 221, page 156; thence with above mentioned Parcel No. 2 S. 84 degrees 40` W. 240.70 feet to a point near a small drain; thence uphill. With the drain N. 18 degrees 12` W. 146.0 feet; `thence leaving the drain and running N. 84 degrees 40` w. 180.0 feet; thence down the hill S. 5 degrees 56` W. 133.8 feet to the beginning, containing 0.64 acre, more or less; and being designated tract no. 1 and shaded yellow on the map attached to deed book 228 at page 512. Tract 3 Beginning at the north corner of Lot No. 91, Section 1 of the Loup Creek Company`s subdivision of surface tracts at page, Fayette County, West Virginia, dated February 1, 1952, and recorded in the office of the clerk of the county court of Fayette County, West Virginia, in Map Book 11, Page 24; thence with Lot No. 91 S. 28 degrees 49` W. 91.35 feet to a point near school house branch; thence leaving Lot No 91 and running up the branch N. 51 degrees 0` E. 190.0 feet to the beginning, containing 0.40 acres, more or less, and being shaded yellow on map of record in the aforesaid clerk`s office in deed book 217 at page 217 entitled: surface Lot 0.40 acres School House Hollow at page, Fayette County, West Virginia, for Everett Hannah, scale 1” = 100` Loup Creek Company, Norfolk, Virginia. Tract 4 Beginning at the northern corner of Lot No. 91, as shown on plan of section 1 of the Loup Creek Company subdivision of surface tracts at page, Fayette County, West Virginia, dated February 1, 1952, and recorded in the office of the clerk of the county court of Fayette County, West Virginia. Dated February 1, 1952 and recorded in the office of the clerk of the County Court Of Fayette County, West Virginia, in Map Book 11, Page 24; said corner is also the beginning corner to the 0.40 acre tract conveyed to Everett Hannah by deed dated September 8, 1959 and recorded in the said clerk`s office in deed book 217, page 217; thence up the Hill N. 28 degrees 49` E. 95.0 feet; thence along the hillside S. 84 degrees 40` E. 240.70 feet to a point near a small drain; thence with the drain S. 18 degrees 21` E. 118.74 feet to a point about 35.0 feet north of Molly Kincaid Branch; thence N. 80 degrees 53` W. Passing the Eastern corner of Lot No. 88 at 41.71 feet and the Eastern corner of Lot No. 91 at 159.92 feet and running 240.70 feet to the beginning, containing 0.64 acre, more or less, and being designated Parcel No. 2 and shaded yellow on said map attached to deed of record in the aforesaid County in deed book 221 at page 157.
TERMS OF SALE:
1) The property will be conveyed in an “AS IS” physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the Clerk’s office or affecting the subject property.
2) The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code § 11-22-1.
3) The Beneficiary and/or the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale.
4) The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee.
5) The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY.
6) The total purchase price is payable to the Trustee within thirty (30) days of the date of sale, with ten (10%) of the total purchase price payable to the Trustee at sale.
