SALE OF FORMER POLICE
DEPARTMENT OFFICES
TOWN OF FAYETTEVILLE,
WEST VIRGINIA

Pursuant to the provisions of West Virginia Code ยง 8-12-18(b) notice is hereby given that on the 25th day of March, 2021, at 10:00 a.m., the Town of Fayetteville will offer for sale at a public auction the former Fayetteville Police Department offices and real estate located at 204 Church Street, Fayetteville, WV, which property was acquired by the Town from Gradon C. Ooten, Jr., et ux, by deed of record in the Office of the Clerk of the Fayette County Commission, Fayetteville, WV, in Deed Book 650 at Page 86, and being described as on the tax records as “surface of 224/ Near Old Preshy Church”, Tax Map 8 Parcel 63, to all of which reference is made for a more particular description of the property to be sold. The auction shall take place at the front door of the property being auctioned.

The real estate will be conveyed by the Town of Fayetteville to the successful purchaser at closing by Deed without warranty of any kind, express or implied, and made subject to all validly continuing reservations, encumbrances, restrictions, right-of-ways, easements, covenants, conveyances and conditions of record in the aforesaid Clerk’s Office.

The property is being sold “As Is” and is available for inspection by contacting Town Hall at 304-574-0101 between the hours of 8:00 a.m. and 4:00 p.m. Monday through Friday for an appointment to inspect the building’s exterior and interior. TERMS OF SALE: A deposit of 10% of the sale price shall be due at the time of the sale and the balance to be paid at closing, which must occur within 20 days of the sale. The auction will be conducted by the Mayor or her designee. A cashier’s check is required.

The Town reserves the right to reject any and all bids if the bid is deemed to be inadequate. The MINIMUM BID is $115,000.00.

CONTINUANCE-ADJOURNMENT OF SALE: The Town of Fayetteville reserves the right to continue the sale from time to time, without further announcement of the time and place of sale as set forth in any continuance or adjournment thereof.
