TRUSTEE’S SALE OF
VALUABLE REAL ESTATE

The undersigned Trustee, by virtue of the authority vested in him by that certain Deed of Trust, dated the 5th day of November, 2019, and duly recorded in the Office of the Clerk of the County Commission of Fayette County, West Virginia, in Trust Deed Book 1023 at page 103, Michael Wilson and Sherri Wilson did convey unto Gregory A. Tucker, Trustee, certain real property described in said Deed of Trust; and default having been made under the aforementioned Deed of Trust, and the undersigned Trustee having been instructed by the secured party to foreclose thereunder, will offer for sale at public auction at the front door of the Fayette County Courthouse in Fayetteville, West Virginia, on

MARCH 17, 2021 at 9:00 A.M.

…the following described real estate, with its improvements, easements and appurtenances thereunto belonging, situate in New Haven District, Fayette County, West Virginia, more particularly bounded and described as follows, to-wit:
BEGINNING at a 3/8″ rebar (found) on the southwest side of an existing drive; thence leaving said drive and with a new line through Craig Williams 14 acre tract, of which this is a part S 33-48-00 W 136.60 feet to a roof bolt (set); thence continuing through Craig Williams 14 acre tract N 59-35-15 W 240.74 feet to a point in the centerline of the existing creek, labeled “A” on an accompanying plat, referenced by a roof bolt (set) which bears S 59-35-15 E 6.62 feet; thence with the meanders of the existing creek N 29-30-06 E 21.46 feet to a point; thence N 38-55-17 E 15.94 feet to a point; thence N 34-02-40 E 12.57 feet to a point; thence N 27-09-03 E 22.29 feet to a point; thence N 24-08-22E 54.96 feet to a point; thence N 14-38-19 E 14.90 feet to a point; thence N 10-22-56 W 6.56 feet to a point; thence N 61-58-13 E 6.76 feet to a point; thence N 13-15-15 E 11.54 feet to a point; thence N 28-38-25 E 17.01 feet to a point; thence N 09-22-12 W 9.18 feet to a point; thence N 30-49-55 E 17.38 feet to a point in the centerline of the creek on the southwest side of the existing drive; labeled “B” on the aforesaid plat, said point bears S 41-53-46 E 219.89 feet from a ½” iron rod (found) with a triple cherry pointer (corner to Craig Williams 14 acre tract, of which this is a part and Arlene & Craig Johnson 2.467 acre tract; thence leaving creek and with said drive, remaining on the southwestern side of S 48-28-32 E 19.28 feet to a roof bolt (set); thence S 51-51-17 E 52.35 feet to a point; thence S 29-48-03 E 27.12 feet to the beginning, containing 1.004 acres. All bearings based on the meridian of 1998, having a declination of 7 degrees, 51 minutes west.
At the time of the execution of the Deed of Trust, this property was reported to have an address of 2801 Edmond Road, Lookout, WV 25868.
AND BEING the same real estate which was conveyed to Michael Wilson and Sherri Wilson, husband and wife, by Tamie E. Grose and Michael J. Grose, her husband, by deed dated November 5, 2019, and recorded in the office of the Clerk of the County Commission of Fayette County, West Virginia, in Deed Book 790 at page 214.
The referenced real estate will be conveyed with no covenants of warranty, and subject to all covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk’s office or visible upon the ground, all prior liens and encumbrances, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges. The purchasers at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property (the cost of the tax stamp to be affixed to the deed).
The subject property will be sold in “AS IS” condition. The Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.
TERMS: Ten percent (10%) of the purchase price as a cash deposit with the balance due and payable within 30 days of the day of sale.
FEDERAL TAX LIEN: In the event that there are Federal Tax Liens against the property, the United States would have the right to redeem the property within a period of 120 days from the date of such sale or the period allowable for redemption under local law, whichever is longer.
Pursuant to the Deed of Trust, the Trustee may postpone the sale by public announcement at the time and place designated or by posting a notice of the same, and act by agent in the execution of the sale. The parties secured by the Deed of Trust reserve the right to purchase the property at such sale.
