NOTICE OF TRUSTEE’S SALE

NOTICE OF TRUSTEE’S SALE is hereby given pursuant to and by virtue of the authority vested in the Trustee(s), Richard A. Pill and David D. Pill, by that certain Deed of Trust dated July 6, 2005, executed by the Borrower(s), Carl J. Hartman and Etta Kay Hartman, to Richard A. Pill and David D. Pill, either of whom may act, the Trustee(s), of record in the Office of the Clerk of the County Commission of Marion County, West Virginia, in Book 837, at Page 1038. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 410 Church St., Grant Town, WV 26574. The Borrower(s) defaulted under the Note and Deed of Trust and the Trustee(s) have been instructed to foreclose under the Deed of Trust. Accordingly, the Trustee(s) will sell the following described property to the highest bidder at the front door of the Courthouse of Marion County, in Fairmont, West Virginia, on the following date:

January 21, 2025, at 4:40 p.m.

All that certain piece or parcel of real estate situate on Tarney`s Run, Grant Town, Paw Paw District, Marion County, West Virginia, more particularly bounded and described as follows:

BEGINNING at a stake in center of county road, on the dividing line between Alpheus Fluharty and A. M. Straight land, thence S. 31° W. 260 feet to a stake in center of county road; thence with the center line of said road S. 33° 20` W. 75 feet to a stake; thence leaving said road S. 60° E. 285 feet to a poplar tree; thence N. 33° 02` E. 77.5 feet to a white oak stump; thence S. 66° 30` E. 420 feet to a stake; thence N. 84° 30` E. 50 feet to a burnt tree; thence N. 13° E. 109.8 feet to a small hickory; thence N. 53° 45` W. 567 feet to O.R.O. pointers; thence N. 58° 10` W. 140.5 feet to the beginning, containing 3.91 acres, more or less, together with the free use of a certain spring of water located on the farm now or formerly owned by the Federal Coal Company near poplar corner in line of said Federal Coal Company and Icy Kennedy.

And being the same real estate conveyed unto Carl J. Hartman and Etta Kay Hartman by the Deed dated the 14th day of June, 2005, from James Ronald Lepock, Gregory Allen Lepock and Margaret V. Lepock, and recorded in the Office of the Clerk of the County Commission of Marion County, West Virginia, in Deed Book 1004, at Page 616.

TERMS OF SALE:

1) The property will be conveyed in an “AS IS” physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the Clerk’s office or affecting the subject property.

2) The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code § 11-22-1.

3) The Beneficiary and/or the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale.

4) The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee.

5) The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY.

6) The total purchase price is payable to the Trustee within thirty (30) days of the date of sale, with ten (10%) of the total purchase price payable to the Trustee at sale.
