NOTICE OF TRUSTEE’S SALE
The undersigned Substitute Trustee, by virtue of the authority vested in her by that certain Deed of Trust executed by and between MICHAEL WAYNE GILES, (“Borrower”), and CARL W. ROOP (First Trustee), and PIONEER COMMUNITY BANK, INC., (“Lender’), dated the 23rd day of March, 2018, and of record in the Office of the Clerk of the Fayette County Commission in Fayette County, West Virginia, in Trust Deed Book 996, at Page 95. Whereas, said Lender having nominated and appointed ANNA R. ZIEGLER, (“Substitute Trustee”), by Substitution of Trustee dated November 15, 2024, and of record in the aforesaid Clerk’s Office in Book 1103 at page 307. Said Deed of Trust being presently in default, the said Substitute Trustee having been requested by the beneficiary thereof so to do, NOW, THEREFORE, I, ANNA R. ZIEGLER, Substitute Trustee as aforesaid, will proceed to sell the hereafter described real estate at public auction on the 18th day of February, 2025, at the hour of 10:30 a.m., to the highest bidder for cash in hand at the front door of the Courthouse of Fayette County, West Virginia, which real estate is located in near the village of Long Branch, Plateau District, Fayette County, West Virginia, and is more particularly described as follows:
BEGINNING at a dogwood and black oak on east bank of Paint Creek N 87-30 E 64 feet N 9 E 327 feet to a stone in edge of road, thence N 20 W 300 feet to a stone on top of the ridge; thence running S 68-35 W 361 feet to a corner in edge of Paint Creek; thence up Paint Creek to the BEGINNING, containing three acres more or less.
There is EXCEPTED and RESERVED from this deed and not transferred hereby that certain one and three-fourths (1 ¾) acre tract previously conveyed out of this three acre tract by William L. Sowder to Clyde Alvin Sowder and Lois G. Sowder by deed dated July 8, 1981, and recorded in Deed Book 404 at page 624, which one and three -fourths (1 ¾) acre tract is more fully described as follows:
BEGINNING at a set stone on top of a ridge near a power pole; thence S 68o 35’ W 36’ feet to an iron pin on the bank of Paint Creek; thence with said creek S 30o E 208 feet to an iron pit in a sycamore stump; thence leaving the said creek N 68o 35’ E 327 feet crossing a road at 270 feet to an iron pin in a fence line on the westerly side of said road; thence N 20o W 206 feet to the point of BEGINNING and containing one and three-fourths (1 ¾) acres more or less.
AND BEING the same property conveyed unto Michael W. Giles from William R. Wooten and Shirliebeth Wooton by deed dated March 23, 2018, and of record in the Office of the Clerk of the Fayette County Commission in Deed Book 758 at Page 605.
THIS SALE IS MADE subject to such easements, rights-of-ways, restrictive covenants, reservations and agreements as are contained and set forth in prior deeds of conveyance pertaining to said real estate.
SAID SALE SHALL BE SUBJECT TO THE FOLLOWING CONDITIONS:
1) Cash or certified funds in hand on day of sale or within 30 days as may be agreed upon by Trustee and Purchaser.
2) Subject to any and all mineral rights and reservations, stipulations, restrictions, reservations, easements, conditions and covenants contained in all former conveyances of the subject property or appearing of record in the aforesaid Clerk’s Office except any pertaining to race, color or creed.
3) Subject to all real estate taxes against said property and any taxes which constitute a lien upon the said property but which are not yet due and payable.
4) The subject property will be sold in AS IS condition. The trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.
5) The property will be conveyed by the undersigned Trustee to the purchaser without warranty of any kind, expressed or implied.
6) The aforesaid sale may be adjourned from time to time as the undersigned Trustee deems advisable, which adjournment may be made by oral proclamation at the time and place of the sale or any adjournment thereof.
