Petition for determination that Armstrong Public Service District is a failing utility under the Distressed or Failing Utility.
NOTICE OF EVIDENTIARY HEARING
On December 13, 2023, Kanawha Falls Public Service District, pursuant to W. Va. Code § 24-2H-6(a), petitioned the Commission for a determination that Armstrong Public Service District is a failing sewer utility under the provisions of W. Va. Code § 24-2H-1.
This matter has been scheduled for an evidentiary hearing on January 30, 2025, at 10:00 a.m. at the Montgomery City Hall, 321 Fourth Avenue, Montgomery, West Virginia. The purpose of the hearing is to determine a plan to improve Armstrong’s system, to consider further options for naming a capable proximate utility, and to consider proposals that Fayuette County Commission may present.
At the evidentiary hearing, the Commission shall receive evidence to determine a plan to improve Armstrong Public Service District’s system and to determine which utility, if any, should be deemed a capable and proximate utility to acquire Armstrong’s sewer system assets.
