NOTICE OF TRUSTEE’S SALE

NOTICE IS HEREBY GIVEN that by virtue of that certain Credit Line Deed of Trust dated November 15, 2013, executed by Michael G. Mullens and Regina L. Mullens to Gary R. Mills and Stephen M. Feola, Trustees, of record in the Office of the Clerk of the County Commission of Raleigh County, West Virginia, in Trust Deed Book 5053, at page 5910, which Deed of Trust was modified by Modification of Deed of Trust dated February 4, 2019, of record in the aforesaid Clerk’s office in Trust Deed Book 5069, at page 1847, David M. Kersey having been substituted as Trustee pursuant to Substitution of Trustee dated February 17, 2020, of record in the aforesaid Clerk’s office in Trust Deed Book 5071, at page 2494. Taylor W. Bohon was substituted as Trustee pursuant to Substitution of Trustee, dated March 1, 2021, of record in the aforesaid Clerk’s office in Trust Deed Book 5073, at page 3920, default having occurred in payment of the indebtedness secured by said Deed of Trust and Modification of Deed of Trust, and the undersigned Substitute Trustee having been requested to do so by First Community Bank, owner and holder of the indebtedness secured by said Deed of Trust and Modification of Deed of Trust, the undersigned Substitute Trustee will offer for sale and sell at public auction on April 7, 2021, at 11:15 a.m., at the front entrance to the Raleigh County Courthouse, 215 Main Street, Beckley, Raleigh County, West Virginia, the following described real estate, together with the improvements thereon and appurtenances thereunto belonging, more particularly bounded and described as follows:
That certain tract and parcel of land, surface only, lying and being on the County Road, which leads from Raleigh to Sullivan, in Shady Spring District, Raleigh County, West Virginia, bounded and described as follows, to wit:
BEGINNING at a stake on north side of public road, a common corner to Sadie McVey and Albert Ward’s land; thence down along the road as it meanders to a set stone at the intersection of James W. Ward’s private road, with said public road a distance of 514 feet, more or less; thence with said James W. Ward’s private road as it meanders to the property line of said Albert Ward and Sadie McVey a distance of 980 feet, more or less; thence with the property line of the said McVey and said Ward S. 44 45′ E. 373 feet, more or less, to the point of beginning, and is a part and a portion of the same land which was conveyed to the said Albert Ward by deed bearing date the 31st day of May, 1919, and is of record in the Office of the Clerk of the County Commission of Raleigh County, West Virginia, in Deed Book 69, at page 447; excepting therefrom the part thereof conveyed by Sadie McVey to C. S. Furrow, containing two (2) acres as described by deed of record in said Clerk’s office in Deed Book 98, at page 284.

TERMS OF SALE: Ten percent (10%) cash in hand on day of sale and balance upon delivery of deed. Sale subject to any and all real property taxes or assessments due or to become due, all applicable subdivision and zoning restrictions, matters of survey, compliance with environmental regulations, rights of tenants in possession, if any, and all other pertinent liens, easements, restrictions and reservations of record. The property is sold in an “as is” condition. The purchaser shall pay the excise tax on the transfer of real estate. Any personal property remaining on the premises at the time of sale shall be considered abandoned. The undersigned trustee reserves the right to reject any and all bids, the right to continue the sale by announcement on the date of the sale and the right to announce other conditions upon the sale, which announced conditions, if any, shall be in addition to or take priority over any conditions set forth herein.
