The undersigned Substitute Trustee, by virtue of the authority vested in it by that certain Deed of Trust dated September 26, 2016, and duly recorded in the Office of the Clerk of the County Commission of Marion County, West Virginia, in Deed of Trust Book 1155, at Page 816, Sandra L. Harger and Charles A. Harris did convey unto Compton and Associates PLLC, Trustee, certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Pill & Pill, PLLC as Substitute Trustee by a Substitution of Trustee recorded in the aforesaid Clerk’s Office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by the secured party to foreclose thereunder, will offer for sale at public auction at the front door of the Marion County Courthouse, in Fairmont, West Virginia, on
July 8, 2025, at 4:40 PM
The following described real estate, with its improvements, easements and appurtenances thereunto belonging, situate in the Union District, Marion County, West Virginia, and more particularly described as follows: All that certain lot or parcel of real estate lying and being situate in the Union District, Marion County, West Virginia, and being more particularly described as follows, to-wit:
TRACT ONE:
Situate on or near Hickman Run, in Union District, Marion County, West Virginia, being a part of what was known as the “James F. Gwynn Farm”, a map or plat of which said farm is of record in the Office of the Clerk of the County Court of Marion County, West Virginia, in Deed Book No. 454, at Page 35, and which said parcel hereby conveyed is bounded and more particularly described as follows:
Beginning at a stone, corner to Lot No. 4, as shown on said map or plat of the James F. Gwynn Farm, and running thence N. 86° 30’ 340.00 feet to a stone in West Virginia Secondary Route No. 31; thence with the easterly line of said Secondary Route No. 31, two lines, N. 10° 00’ E. 41.00 feet to a stake and N. 7° 00’ W. 19.59 feet to a stake; thence leaving said Secondary Route No. 31 and running S. 86° 30’ E. 359.00 feet to a stake in a line of said Lot No. 4; thence with a part of said line, S. 21° 30’ W. 63.09 feet to the place of beginning, containing 0.47 of an acre, more or less; and being a part of Lot Number Five (No. 5) as shown on said map or plat of James F. Gwynn Farm.
Being certain real estate conveyed to George A. Thomas and Barbara Lorraine Thomas by deed dated the 14th day of August, 1974, of record in the Office of the Clerk of the County Commission of Marion County, West Virginia, in Deed Book 780, Page 833. Thereafter, the said Barbara Lorraine Thomas died September 30, 2015 and by the survivorship provision contained in the aforementioned deed the property became fully vested in Geroge A. Thomas.
TRACT TWO:
Beginning at a 1/2” iron pin set on the eastern edge of West Virginia Secondary Route 310; thence along Route 310 for two lines, N. 7° 00’ W. 80.41 feet to a point; thence N. 28° 00’ W. 25.64 feet to a point leaving Route 310 with an arbitrary line through Lyle Parsons, S. 83° 44’ 05” E. (passing through a power pole at 18.21 feet and a 1/2” iron pin set at 88.37 feet) to a 1/2” iron pin in the line of Marion County Memorial Gardens, corner to Lyle Parsons; thence with the line of Marion County Memorial Gardens, S. 21° 30’ W. 85.13 feet to a 1/2” iron pin set, corner to Geroge Thomas; thence with a line of Thomas, N. 86° 30’ W. 359.00 feet to the place of beginning, containing 0.798 acres.
Being that certain real estate conveyed to George A. Thomas and Barbara Lorraine Thomas by deed dated the 27th day of July, 1995, of record in the Office of the Clerk of the County Commission of Marion County, West Virginia, in Deed Book 928, Page 121. Thereafter, the said Barbara Lorraine Thomas died September 30, 2015 and by the survivorship provision contained in the aforementioned deed the property became fully vested in George A. Thomas.
TRACT THREE:
Parcel One
Beginning at a stake in an outline, and running thence N. 11° W. 115 feet to a stake, corner to Lot No. 4; thence with a line thereof, N. 86 ½ ° W. 340 feet to a stake in the center of the Grafton Turnpike; thence with the same, S. 10° E. 111 feet to a stake, corner to Lot No. 7; thence S. 86 ½° E. 380 feet to the place of beginning, containing 0.93 acre, more or less, and designated as Parcel No. 2, Lot No. 6A, in a deed from Cyrena I. Hawkins, et al., to Beulah Price Hawkins, dated July 27, 1944, of record in the Office of the Clerk of the County Commission of Marion County, West Virginia, in Deed Book No. 444, at Page 44.
Parcel Two
Beginning at a stake in an outline, and running thence N. 11° W. 102 feet to a stake, corner to Lot No. 6; thence with on line thereof, N. 86 ½ ° W. 380 feet to the center of the Grafton Turnpike; thence with the same, S. 10° E., 100.8 feet to a stake; thence S. 3° 5.3 feet to a stake, corner to Lot No. 6; thence with the same, S. 86 ½ ° E. 420 feet to the place of beginning, containing 0.92 acres, more or less, and designated as Parcel 3, Lot No. 78 in the aforementioned Hawkins deed.
Being certain real estate conveyed to George A. Thomas and Barbara Lorraine Thomas by deed dated 07/19/96, of record in the Office of the Clerk of the County Commission of Marion County, West Virginia, in Deed Book 934, Page 458. Thereafter, the said Barbara Lorraine Thomas died 09/30/15 and by the survivorship provision contained in the aforementioned deed the property became fully vested in George A. Thomas.
And further being all the same real estate conveyed to the Grantor(s) herein by deed of even date to be recorded simultaneously herewith in the Office of the Clerk of the County Commission of Marion County, West Virginia.
This conveyance is made subject to any and all existing reservations, restriction, rights-of-way, and conditions as are contained in the chain of title to said property.
At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 595 East Grafton Road, Fairmont, WV 26554.
AND BEING the same real estate which was conveyed to Sandra L. Harger and Charles A. Harris, by Deed dated September 20, 2016, from George A. Thomas, and recorded in the Office of the Clerk of the County Commission of Marion County, West Virginia, in Deed Book 1198, at Page 144.
The above-described property will be sold subject to any covenants, restrictions, easements, leases and conditions of record, and subject to any unpaid real estate taxes.
The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.
TERMS: Ten percent (10%) of the purchase price as a deposit with the balance due and payable within 30 days of the day of sale.
