ADVERTISEMENT FOR BIDS

TOWN OF BRADSHAW
MCDOWELL COUNTY, WV

TOWN OF BRADSHAW SANITARY SEWER UPGRADE PROJECT

Town of Bradshaw is requesting Bids for the construction of the following Project:
Sanitary Sewer Upgrade Project
Contract No. 1

Sealed Bids for the construction of Contract No. 1 will be received by Town of Bradshaw at their Town Hall located at 10022 Marshall Highway; Bradshaw, WV 24817, until 11:00 A.M. local time on July 8th, 2025, at which time the Bids received will be publicly opened and read.

The Project (Contract No. 1) includes the following Work:

Furnishing all materials, labor, and necessary items for the construction and installation of approximately 30 linear feet (LF) of 10-inch gravity sewer, 6840 LF of 8-inch gravity sewer, 7562 LF of 6-inch gravity sewer, 3275 LF of 4-inch gravity service laterals, 150 LF of 6-inch force main, 1712 LF of 4-inch force main, 155 LF of 1 ½-inch force main, 235 LF of 1 ¼-inch force main, 125 manholes, 3 grinder pumping stations and all necessary appurtenances.

Bids shall be on a lump sum and unit price basis as indicated in the Bid Form.

Contract Times for Contract No. 1: 335 calendar days to substantial completion and 365 calendar days to complete work ready for final payment. Contractor shall pay Owner $1,000 for each day that expires after the time (as duly adjusted pursuant to the Contract) for Substantial Completion until the Work is substantially complete.

Bids shall be submitted on the furnished Bid forms. Bids shall be on a unit price basis as indicated on the Bid Form. The bids shall be submitted using the two (2) envelope system. Envelope #1 will contain the required bid documents. Envelope #2 will contain only the bid form and bid schedule.

The Owner reserves the right to reject any or all bids.

The Town of Bradshaw has tax exemption for all materials.

Printed copies of the Bidding Documents may be obtained from the Issuing Office, during the hours indicated above, upon payment of a deposit of $200.00 for each set. Checks for Bidding Documents shall be payable to “E.L. Robinson Engineering Company”. Upon request and receipt of the document deposit indicated above, the Issuing Office will transmit the Bidding Documents via delivery service. The date that the Bidding Documents are transmitted by the Issuing Office will be considered the Bidder’s date of receipt of the Bidding Documents. Partial sets of Bidding Documents will not be available from the Issuing Office. Neither Owner nor Engineer will be responsible for full or partial sets of Bidding Documents, including Addenda if any, obtained from sources other than the Issuing Office.

The Owner reserves the right to reject any and all bids.

Pre-bid Conference
A Mandatory pre-bid meeting will be conducted at the Town of Bradshaw Town Hall at 11:00 A.M. on June 18th, 2025. Attendance at the pre-bid meeting is mandatory.

This project is to be funded by a grant from the West Virginia Department of Environmental Protection, Abandoned Mine Lands (AML) Program and funding from the Clean Water State Revolving Fund (CWSRF) and shall be referred to as the Town of Bradshaw Sanitary Sewer Upgrade Project. All prospective Contractors and Sub-contractors must meet eligibility requirements Office of Surface Mining Reclamation and Enforcement regulations at 30 CFR 874.16.

This project will be partially funded with Federal funds from the United States Department of Agriculture – Rural Utilities, and therefore is subject to the Federal laws and regulations associated with that program.

Bidders on this work will be required to comply with the President’s Executive Order No. 11246 entitled “Equal Employment Opportunity” as amended by Executive Order No. 11375 which prohibits discrimination in employment regarding race, creed, color, sex or national origin.

Bidders must comply with the requirements for Affirmative Action and Minority Business Enterprises participation as described in the Federal Specifications insert to the Contract Documents. Bidders much comply with Title VI of the Civil Rights Act of 1964, the Copeland Anti-Kickback Act, the Contract Work Hours and Safety Act and the Drug-Free Workplace Provisions pursuant to West Virginia Code § 21-1D-5.

Contractors are required to comply with all laws pertaining to the federal wage rates issued in accordance with the Davis Bacon Act.

All bid must be accompanied by a Bid Guarantee Bond payable to the Owner for five percent (5%) of the total amount of the Bid or a Certified Check, Cashier’s Check, or Letter of Credit in the amount of not less than five percent (5%) of the Bid.

No Bidder may withdraw their bid for a period of ninety (90) days after the time of the opening of the Bids.

All bidders are required to have a West Virginia contractor’s license per Section WV-30-42-12 of the West Virginia Code. A Contractor’s License Number is to be included on the bid submission.

Pursuant to West Virginia Code § 5-22-2, requirements stated in the advertisement for bids and the bid form may not be waived by any public entity.

AMERICAN IRON AND STEEL REQUIREMENT
P.L. 113-76, Consolidated Appropriations Act, 201 (Act), includes an “American Iron and Steel (AIS)” requirement in section 436 that requires Clean Water State Revolving Loan Fund (CWSRF) and Drinking Water State Revolving Loan Fund (DWSRF) assistance recipients to use iron and steel products that are produced in the United States for projects for the construction, alteration, maintenance, or repair of a public wastewater and water system or treatment works.

Section 746 of Title VII of the Consolidated Appropriations Act of 2017 (Division A-Agriculture, Rural Development, Food and Drug Administration, and Related Agencies Appropriations Act, 2017) and subsequent statutes mandating domestic preference applies an American Iron and Steel requirement to this project. All listed iron and steel products used in this project must be produced in the United States. The term “iron and steel products” means the following products made primarily of iron or steel: lined or unlined pipes and fittings, manhole covers and other municipal castings, hydrants, tanks, flanges, pipe clamps and restraints, valves, structural steel, reinforced precast concrete, and construction materials. The deminimis and minor components waiver (none added) apply to this contract.

DBE REQUIREMENTS
Each bidder must fully comply with the requirements, terms, and conditions as set forth in the contract documents to achieve Disadvantaged Business Enterprise (DBE) participation during the performance of this contract. The bidder commits itself to the program for DBE participation and all other requirements, terms, and conditions of the bid conditions by submitting a properly signed bid.

The bidder agrees to make “good faith efforts” to sub-contract a portion of the total value of the contract to Disadvantaged businesses. This shall be done in compliance with the six (6) good faith efforts as outlined in 40 CFR 31.36(e). Failure to demonstrate good faith efforts may lead to rejection of bids. For the purpose of this program, the term “subcontractor” includes all construction, modification, and service work contracted for by the bidder in the execution of the work under this contract.

SUSPENSION AND DEBARMENT
Recipient shall not entertain the use of businesses that are listed on the “System for Award Management (SAM)” at www.sam.gov in accordance with 2 CFR Part 1532 and Subpart B and C of 2 CFR Part 180.

All fees associated with the purchase of Project Specifications, Contract Documents, Plans, and Shipping are non – refundable.
