NOTICE OF TRUSTEE’S SALE

NOTICE OF TRUSTEE’S SALE is hereby given pursuant to and by virtue of the authority vested in the Substitute Trustee, WV Trustee Services, LLC, by that certain Deed of Trust dated September 19, 2016, executed by Borrower(s), Katy M Trent, to Brian A. Abraham, the Trustee of record in the office of the Clerk of the County Commission of Wyoming County, West Virginia, in Book 280, at Page 148. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 105 Rose Mountain, Oceana, WV 24870. WV Trustee Services, LLC were appointed as Substitute Trustees on September 24, 2024, by APPOINTMENT OF SUCCESSOR TRUSTEE, recorded in the aforesaid Clerk’s office in Book 304, at Page 686. The borrower(s) defaulted under the Note and Deed of Trust and the Substitute Trustees have been instructed to foreclose under the Deed of Trust. Accordingly, the Substitute Trustees will sell the following described property to the highest bidder at the front door of the Courthouse of Wyoming County, in Pineville, West Virginia, on the following date:

8th day of July, 2025 at 12:00 p.m.

All those certain tracts or parcels of land, situate, lying and being in Oceana Sub District, Wyoming County, West Virginia and being more particularly described as follows: All the following described real estate, and being those certain pieces, parcel or tracts of real estate, in fee, containing 71.05 acres, more or less, One (1) acre, more or less, and One and Forty Eight Hundredths (1.48) of an acre, together with the improvements thereon and all of the rights, privileges, easements and appurtenances thereunto belonging, situate on the Clear Fork of the Guyandotte River, in the Town of Oceana, Oceana District, Wyoming County, West Virginia, and being the same property conveyed to Ronald D. Mathis and Karen L. Mathis, husband and wife, by Maxine Barrett, widow, by a deed dated the 25th day of May, 1983, and of record in the Office of the Clerk of the County Commission of Wyoming County, West Virginia, in Deed Book 339, at Page 324, to which reference is hereby made for a more complete description. ALSO SPECIFICALLY INCLUDING, the fee simple interest, including any and all minerals and mineral rights underlying the real estate herein described, as well as any oil and gas, if any. EXCEPTING AND RESERVING, THEREFROM, HOWEVER, the following real estate: 1. Portions of said real estate, if any, which lie on the west side of West Virginia State Route 10. 2. The interest in said real estate conveyed by Ronald D. Mathis and Karen L. Mathis to First Community – Oceana National, by deed dated June 20, 1984, and recorded June 21, 1984, in Deed Book No. 344, at Page 98, consisting of two surface parcels of 0.85 acres, more or less, and 1.30 aces, more or less, and one right of way containing 0.26 acres, more or less. And being the same property conveyed to Katy M. Trent, by a deed dated September 1, 2016, from Donnie R. Rose and Nola A. Rose, which deed is recorded in Deed Book 476, at Page 67, in the Office of the Clerk of the County Commission of Wyoming County, West Virginia.

TERMS OF SALE:
1) The property will be conveyed in an “AS IS” physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the Clerk’s office or affecting the subject property.

2) The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code § 11-22-1.

3) The Beneficiary and/or the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale.

4) The Trustee reserves the right to continue sale of the subject property
from time to time by written or oral proclamation, which continuance
shall be in the sole discretion of the Trustee.

5) The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY.

6) The total purchase price is payable to the Trustee within thirty (30) days of the date of sale, with ten (10%) of the total purchase price payable to the Trustee at sale.
