NOTICE OF TRUSTEE’S SALE
NOTICE OF TRUSTEE’S SALE is hereby given pursuant to and by virtue of the authority vested in the Substitute Trustee, Pill & Pill, PLLC, by that certain Deed of Trust dated June 16, 2023, executed by the Borrower(s), Elizabeth Mae Hill and Tricia May Hill, to Douglas McElwee, the Trustee, of record in the Office of the Clerk of the County Commission of Marion County, West Virginia, in Book 1324, at Page 766. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 1113 Country Club Rd., Fairmont, WV 26554. Pill & Pill, PLLC was appointed as Substitute Trustee by an APPOINTMENT OF SUCCESSOR TRUSTEE dated August 14, 2024, of record in the Clerk’s Office in Book 1347, at Page 332. The Borrower(s) defaulted under the Note and Deed of Trust and the Substitute Trustee has been instructed to foreclose under the Deed of Trust. Accordingly, the Substitute Trustee will sell the following described property to the highest bidder at the front door of the Courthouse of Marion County, in Fairmont, West Virginia, on the following date:
July 8, 2025, at 4:48 p.m.
All those certain lots or parcels of real estate situate in Block 2 Edgemont Addition to the City of Fairmont, Marion County, West Virginia, a map or plat of which Addition is of record in the Office of the Clerk of the County Commission of Marion County, West Virginia, in Deed Book No. 149, at page 94, which lots or parcels are described as follows:
FIRST PARCEL: LOT NO. 15 in BLOCK NO. 2 of said Edgemont Addition, as shown on said plat thereof, to which reference is hereby made for all pertinent purposes, and which said lot or parcel of real estate is more particularly bounded and described as follows: Beginning at a point in the northerly line of Country Club Road, a common corner of Lots Nos. 14 and 15 of said block of said addition, which said beginning point is located S. 65° 30` E. 151.47 feet from the easterly line of Barry Street; and running thence with the division line of said Lots Nos. 14 and 15 N. 32° 30` E. 148.59 feet to a stake in the southerly line of a 15 foot alley, another common corner of said Lots Nos. 14 and 15, thence with said southerly line of said alley, S. 57° 30` E. 50.00 feet to a stake in said line of said alley, common corner of Lots Nos. 15 and 16; thence with the division line of said Lots Nos. 15 and 16, S. 32° 30` W. 141.56 feet to a stake in said northerly line of Country Club Road, another common corner of said Lots Nos. 15 and 16; thence with said northerly line of Country Club Road, N. 65° 30` W. 50.49 feet to the place of beginning.
SECOND PARCEL; The westerly portion of LOT NO. 16, BLOCK 2 of said Edgemont Addition, as subdivided and approved on February 1, 1960, by the Board of Directors City of Fairmont and depicted on that certain map by George A. Mason, C.E., dated Jan. 1960, and entitled “Map Showing Sub-division of Lot No. 16 Block No. 2 Flemming Addn., to Fairmont Ralph & Helen Dollison, Owners”, which map is of record in the aforesaid Clerk`s office in Deed Book No. 618 at page 70 and re-recorded in Deed Book No. 619, at page 45, to which reference is hereby made for all pertinent purposes, and which said lot or parcel of real estate is more particularly bounded and described as follows: Beginning at an iron pin in the northerly line of Country Club Road (formerly Edgemont Avenue), and running thence with said line of Country Club Road, N. 65° 30` W. 20.19 feet to a stake, common corner of Lot Nos. 15 and 16 of said Addition; running thence with the dividing line of said Lots Nos. 15 and 16, N. 32° 30 E. 141.52 feet to a stake in the southerly line of a 15.00 foot alley, another common corner of Lot Nos. 15 and 16 of said Addition; thence with the southerly line of said alley, S. 57° 30` E. 20.00 feet to an iron pin; thence with line running through Lot No. 16, S. 32° 30` W. 138.71 feet to an iron pin, the place of beginning, being the westerly 20 feet of Lot No. 16.
THIRD PARCEL: The easterly portion of LOT NO. 16, BLOCK 2 of said Edgemont Addition, as subdivided and approved on February 1, 1960, by the Board of Directors City of Fairmont and depicted on that certain map by George A. Mason, C.E., dated Jan. 1960, and entitled “Map Showing Sub-division of Lot No. 16 Block No. 2 Flemming Addn., to Fairmont Ralph & Helen Dollison, Owners”, which map is of record in the aforesaid Clerk`s office in Deed Book No. 618 at page 70 and re-recorded in Deed Book No. 619, at page 45, to which reference is hereby made for all pertinent purposes, and which said lot or parcel of real estate is more particularly bounded and described as follows: Beginning at a stake in the northerly line of Country Club Road, common corner to Lot No. 16 and Lot No. 17 of said Edgemont Addition, thence with line of said road N. 65° 30` W. 35.34 feet to an iron pin; thence with line running through Lot No. 16, N. 32° 30` E. 138.71 feet to an iron pin in the southerly line of a 15 foot alley; thence with said line of said 15 foot alley, S, 57° 30` E. 35 feet to a stake, common corner to Lot No. 17; thence with line of Lot No. 17, S. 32° 30 W. 133.79 feet to the place of beginning, being the easterly 35 feet of said Lot No. 16.
Being the same real estate conveyed unto Tricia M. Hill and Elizabeth M, Hill as joint tenants with the right of survivorship from the Secretary of Housing and Urban Development by deed dated June 12, 2023, and recorded in Deed Book 1325, at Page 186-192.
TERMS OF SALE:
1) The property will be conveyed in an “AS IS” physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the Clerk’s office or affecting the subject property.
2) The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code § 11-22-1.
3) The Beneficiary and/or the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale.
4) The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee.
5) The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY.
6) The total purchase price is payable to the Trustee within thirty (30) days of the date of sale, with ten (10%) of the total purchase price payable to the Trustee at sale.
