The undersigned Substitute Trustee, by virtue of the authority vested in him by that certain Deed of Trust, dated October 9, 2003, and duly recorded in the Office of the Clerk of the County Commission of Raleigh County, West Virginia, in Document No. 50108452, in Book No. 5010, at Page 8452, Peter A Weber did convey unto Jonathan Nicol, Trustee(s), certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Seneca Trustees, Inc., as Substitute Trustee by a Substitution of Trustee dated October 29, 2020 and recorded in the aforesaid Clerk’s office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by Towd Point Mortgage Trust 2017-1, U.S. Bank National Association, as Indenture Trustee to foreclose thereunder, will offer for sale at public auction at the front door of the Raleigh County Courthouse in Beckley, West Virginia, on

the following described real estate, together with its improvements, easements and appurtenances thereunto belonging, situate in 04 – Mabscott District, Raleigh County, West Virginia, and more particularly described as follows:
PARCEL NO. 1: The surface of the following described lot or parcel of land situated in Mabscott, Raleigh County, West Virginia, and more particularly described as Lot No. 1, Section 4, as shown and designated on a map entitled “Map of Lots Showing Sub-division of South Wickham, Raleigh County, West Virginia, and further described as follows:
BEGINNING at a stake on Ridge Street; thence with same S. 72 degrees 28′ E 60 feet to a stake; thence S. 10 degrees 30′ W. 215 feet to a stake; thence N. 72 degrees 28′ W. 60 feet to a stake; thence N. 10 degrees 30′ E. 215 feet to the beginning.
Being the same property conveyed to Peter A. Weber and Patricia H. Weber, husband and wife, by a deed from Sylvin Todd and Thelma A. Todd, husband and wife, dated the 8th day of May, 1998 and recorded in the aforesaid Clerk’s Office on Microfilm Roll 133, at page 2027.
PARCEL NO. 2: The surface of the following described tract of land situated in Mabscott, Raleigh County, West Virginia, and more particularly described as follows:
BEGINNING at a rebar on the right of way of Ridge Street being the northeast corner of Lot 1 and Lot 148, the Beulah E. Pack parcel of land; thence with the right of way of Ridge Streets S. 72 degrees 28′ E. 4.5 feet to a point, a new corner; thence leaving the right of way of Ridge Street and with two new lines through Lot 148, S. 10 degrees 30′ W. 215 feet to a point, a new corner; N. 72 degrees 28′ W. 4.5 feet to a point, a new corner being the common lot line of Lot No. 1 and Lot No. 148; thence with the common line of Lot No. 1 and Lot No. 148, N. 10 degrees 30′ E. 215 feet to the point of beginning, and containing 0.022 acres, more or less.
Being the same property conveyed to Peter A. Weber and Patricia H. Weber, husband and wife, by a deed from Beulah E. Pack, unmarried, dated the 22nd day of May, 1998 and recorded in the aforesaid Clerk’s Office on Microfilm Roll 134, at page 1934.
At the time of the execution of the Deed of Trust, this property was reported to have an address of: 117 Ridge Street, Mabscott, WV 25871.
The referenced real estate will be conveyed with no covenants of warranty, and subject to all covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk’s Office or visible upon the ground, all prior liens and encumbrances, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges. The purchasers at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property (the cost of the tax stamp to be affixed to the deed). The purchasers shall be responsible for payment of all real estate taxes.
The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.
TERMS: $6000.00 in cash and/or certified funds as deposit at the time of sale with the balance due and payable within 30 days of the day of sale.
FEDERAL TAX LIEN: In the event that there are Federal Tax Liens against the property, the United States would have the right to redeem the property within a period of 120 days from the date of such sale or the period allowable for redemption under local law, whichever is longer.
Pursuant to the Deed of Trust, the Trustee may postpone the sale by public announcement at the time and place designated or by posting a notice of the same, and act by agent in the execution of the sale. The parties secured by the Deed of Trust reserve the right to purchase the property at such sale.
