The undersigned Substitute Trustee, by virtue of the authority vested in it by that certain Deed of Trust dated April 20, 2017, and duly recorded in the Office of the Clerk of the County Commission of Fayette County, West Virginia, in Deed of Trust Book 982, at Page 665, Jimmy McIntyre a/k/a Jimmy Lee McIntrye did convey unto Todd Taylor and Dan Kennedy, Trustee, certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Pill & Pill, PLLC as Substitute Trustee by a Substitution of Trustee recorded in the aforesaid Clerk’s Office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by the secured party to foreclose thereunder, will offer for sale at public auction at the front door of the Fayette County Courthouse, in Fayetteville, West Virginia, on

June 3, 2021, at 8:00 AM

The following described real estate, with its improvements, easements and appurtenances thereunto belonging, situate in the Valley District, Fayette County, West Virginia, and more particularly described as follows:

The following described tract or parcel of real estate, situate on the waters of Gauley River, Valley District, Fayette County, West Virginia, and being more particularly bounded and described as follows, to-wit:
Beginning at an iron pin at the corner of Cemetery Lane; thence running up the hill 60 rods to a corner stone of the Newman line; thence up the river 29 rods with the Newman line to an iron post joining Bracken’s line; thence down the hill 53 rods with Bracken’s line to an iron post and the cemetery line; thence down the river 13 rods to the beginning.
There is reserved but not conveyed by this Deed, a twelve (12) foot right-of-way from the spring up the hill to the Newman line as is reserved in the Deed hereinafter mentioned.

At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 158 Dickinson Cemetery Road, Belva, WV 26656.

AND BEING the same real estate which was conveyed to Jimmy McIntyre a/k/a Jimmy Lee McIntrye, by Deed dated January 9, 2006, from Homer Ray McIntyre, Albert Richard McIntyre, and Willard Franklin McIntyre, and recorded in the Office of the Clerk of the County Commission of Fayette County, West Virginia, in Deed Book, 618 at Page 457.

The above-described property will be sold subject to any covenants, restrictions, easements, leases and conditions of record, and subject to any unpaid real estate taxes.

The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.

TERMS: Ten percent (10%) of the purchase price as a cash deposit with the balance due and payable within 30 days of the day of sale.
