The undersigned Substitute Trustee, by virtue of the authority vested in him by that certain Deed of Trust, dated September 24, 2014, and duly recorded in the Office of the Clerk of the County Commission of Raleigh County, West Virginia, in Document No. 50567344, in Book No. 5056, at Page 7344, Guthrie A Cogar and Holly Cogar did convey unto Douglas McElwee, Trustee(s), certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Seneca Trustees, Inc., as Substitute Trustee by a Substitution of Trustee dated May 6, 2021, and recorded in the aforesaid Clerk’s office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by Quicken Loans, LLC to foreclose thereunder, will offer for sale at public auction at the front door of the Raleigh County Courthouse in Beckley, West Virginia, on

Beginning on a 5/8″ rebar (set) with a plastic cap stamped “S.R. STEWART 994 S.U.”, hereinafter referred to as a rebar (set), said rebar being at the toe of the road bank of Logan Turnpike, 15.0 feet southeast of the centerline of the Logan Turnpike, bearing N 85 degrees 45′ W 263.80 feet from a 1″ axle (found), and bearing S 53 degrees 56′ W 133.80 feet from a 1″ rebar (found), said rebar being the eastern corner of the original Lot No. 37 of the Charles Stansbury Sub-Division, also the eastern corner of the Nola Fay Farmer tract (parts of Lots 37, 39, & 41) (Will Book 5025, Page 9605), the northern corner of Lot No. 39 of the Division of the Home Tract of the Charles Stansbury Estate, also the northern corner of the Jerry F. L. and Nola Farmer Lot No. 43 and the Nola Fay Farmer tract (parts of Lots 37, 39, & 41), N 21 degrees 22′ E 300.97 feet to a rebar (set), said rebar being at the top edge of the bank of the Logan Turnpike, 9.5 feet southwest of the edge of the pavement and bearing N 48 degrees 46′ W 97.33 feet from a 1″ rebar (found), said rebar being the northern corner of the original Lot No. 41 of the Charles Stansbury Sub-Division, also the northern corner of the Nola Fay Farmer tract (parts of Lots 37, 39, & 41) (Will Book 5025, Page 9605), the northeastern corner of the Pamela, Rex L. & Nola Farmer Lot No. 43 (Deed Book 5010, Page 1800) and in the southern right-of-way line of the Logan Turnpike; thence, leaving the Pamela, Rex L. & Nola Farmer Lot No. 43 and with the common line between the Nola Fay Farmer tact (parts of Lots 37, 39, & 41) and said right-of-way line of the Logan Turnpike for a distance of approximately 96.87 feet, and having a chord of, S 30 degrees 31′ E 95.32 feet to a 24″ spruce (found), said spruce being 15.0 feet southwest of the centerline of the Logan Turnpike, said spruce being the northeastern corner of the original Lot No. 41, the northwestern corner of the original Lot No. 39 and in the southern right-of-way line of the Logan Turnpike; thence, continuing with the common line between the Nola Farmer tract (parts of Lots 37, 39, & 41) and said right-of-way line of the Logan Turnpike for a distance of approximately 77.51 feet, and having a chord of, S 71 degrees 40′ 75.11 feet to a mag nail (set), said nail being in the pavement of a driveway, said nail being the northeastern corner of Lot No. 39, the northwestern corner of the original Lot No. 37 and in the southern right-of-way line of the Logan Turnpike; thence, continuing with the common line between the Nola Fay Farmer tract (parts of Lots 37, 39, & 41) and said right-of-way lien of the Logan Turnpike for a distance of approximately 118.69 feet, and having a chord of, N 61 degrees 01′ E 117.53 fee to the Point of Beginning, containing 1.36 acres, more or less, and being all of the same tract or parcel of land bequeathed unto Nola Fay Farmer by will recorded in the Office of the Clerk of the County Commission of Raleigh County, West Virginia, in Will Book 5025, Page 9605 and as shown and designated on a map or plat entitled: “PLAT OF SURVEY SHOWING A 1.36 ACRE TRACT, IN THE CHARLES STANSBURY SUB-DIVISION, FOR NOLA FARMER, LYING ON THE SOUTHERN SIDE OF THE LOGAN TURNPIKE, SITUATE ON THE WATERS OF MARSH FORK, TRAP HILL DISTRICT, RALEIGH COUNTY, WEST VIRGINIA, SCALE: 1: = 40′, DATE: AUGUST 05, 2011, SURVEY AND MAP BY: ASHRYN SURVEYING”.

At the time of the execution of the Deed of Trust, this property was reported to have an address of: 659 Logan, Fairdale, WV 25839.

The referenced real estate will be conveyed with no covenants of warranty, and subject to all covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk’s Office or visible upon the ground, all prior liens and encumbrances, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges. The purchasers at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property (the cost of the tax stamp to be affixed to the deed). The purchasers shall be responsible for payment of all real estate taxes.

The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.

TERMS: $8000.00 in cash and/or certified funds as deposit at the time of sale with the balance due and payable within 30 days of the day of sale.

FEDERAL TAX LIEN: In the event that there are Federal Tax Liens against the property, the United States would have the right to redeem the property within a period of 120 days from the date of such sale or the period allowable for redemption under local law, whichever is longer.

Pursuant to the Deed of Trust, the Trustee may postpone the sale by public announcement at the time and place designated or by posting a notice of the same, and act by agent in the execution of the sale. The parties secured by the Deed of Trust reserve the right to purchase the property at such sale.
