The undersigned Substitute Trustee, by virtue of the authority vested in him by that certain Deed of Trust, dated April 25, 2014, and duly recorded in the Office of the Clerk of the County Commission of Raleigh County, West Virginia, in Document No. 50551077, in Book No. 5055, at Page 1077, David W Gross did convey unto Carl W. Roop, Trustee(s), certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Seneca Trustees, Inc., as Substitute Trustee by a Substitution of Trustee dated July 13, 2021, and recorded in the aforesaid Clerk’s office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by The Huntington National Bank to foreclose thereunder, will offer for sale at public auction at the front door of the Raleigh County Courthouse in Beckley, West Virginia, on

the following described real estate, together with its improvements, easements and appurtenances thereunto belonging, situate in 12 – Trap Hill District, Raleigh County, West Virginia, and more particularly described as follows:

The following lot or parcel of land, along with the all improvements thereon, and all of the rights, privileges, easements and appurtenances thereunto belonging, located in Trap Hill District, Raleigh County, West Virginia, and being more particularly described as follows:
BEGINNING on a 5/8″ rebar (set), 15.0′ northeast of the centerline of the road, 6.8′ south-southwest of a 17″ maple, and 19.4′ southeast of APCO pole 819-C-1, said rebar being a corner to the tract herein described and a point on the line of the Shannon and Judy Daniel 2.93 acre ± tract; thence, leaving the Shannon and Judy Daniel 2.93 ± acre tract with the line of the tract herein described, N 20deg. E 92.84′ to a 5/8″ rebar (set), 6″ northwest of a chain-line fence corner and 4.6′ northwest of a 20″ maple, said rebar being a corner to the tract herein described; thence, continuing, S 67deg. 35′ E 172.22′ to a 5/8″ rebar (set), 6″ north of a chain-link fence corner, said rebar being a corner to the tract herein described; thence, continuing, S 17deg. 08″ W 106.21′ to a 5/8″ rebar (set), 15.0′ northeast of the centerline of the road, 11.4′ southeast of a chain-link fence corner post, and 14.0′ southwest of the fence line, said rebar being a corner o the tract herein described and a point on the line of the Shannon and Judy Daniel 2.93 acre ± tract; thence, with the line of the Shannon and Judy Daniel 2.93 ± acre tract and the line of the tract herein described, N 69deg. 27′ W 179.92′ to the Point of Beginning, containing 0.40 acre, more or less, and being part of a tract conveyed to Shannon and Judy Daniel by deed recorded in the Office of the Clerk of the County Commission of Raleigh County, West Virginia in Deed Roll 5022 at Page 7414 and as shown or designated on a map or plat entitled: PLAT OF SURVEY SHOWING A 0.40 ACRE ± TRACT FOR SHANNON AND JUDY DANIEL LYING NORTHEAST OF COUNTY ROUTE 13, SITUATE ON THE WATERS OF MARSH FORK ON THE COAL RIVER, TRAP HILL DISTRICT, RALEIGH COUNTY, WEST VIRGINIA, SCALE: 1″ + 50′ DATE: SEPTEMBER 09, 2006, SURVEY AND MAP BY ASHRYN SURVEYING”
And being the same property conveyed to David W. Gross by Deed dated the 25th day of April, 2014 from Tiffany Francis Miller (fka Tiffany R. Francis), which said Deed is to be recorded in the Office of the Clerk of the County Commission of Raleigh County, West Virginia prior to or simultaneously herewith.

At the time of the execution of the Deed of Trust, this property was reported to have an address of: 322 Saxon Rd, Fairdale, WV 25839.

The referenced real estate will be conveyed with no covenants of warranty, and subject to all covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk’s Office or visible upon the ground, all prior liens and encumbrances, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges. The purchasers at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property (the cost of the tax stamp to be affixed to the deed). The purchasers shall be responsible for payment of all real estate taxes.

The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.

TERMS: $7000.00 in cash and/or certified funds as deposit at the time of sale with the balance due and payable within 30 days of the day of sale.

FEDERAL TAX LIEN: In the event that there are Federal Tax Liens against the property, the United States would have the right to redeem the property within a period of 120 days from the date of such sale or the period allowable for redemption under local law, whichever is longer.

Pursuant to the Deed of Trust, the Trustee may postpone the sale by public announcement at the time and place designated or by posting a notice of the same, and act by agent in the execution of the sale. The parties secured by the Deed of Trust reserve the right to purchase the property at such sale.
