NOTICE OF TRUSTEE’S SALE
In execution of the deed of trust, dated May 21, 2015, from Henry Perdue, Jr. and Michelle Perdue to Gary R. Mills, as trustee, of record in the Office of the Clerk of the County Commission of Raleigh County, West Virginia, in Book 5058, at page 8268, the undersigned trustee will offer for sale at public auction on August 24, 2021, at 11:00 a.m., at the Main Street entrance of the Raleigh County Courthouse, 215 Main Street, Beckley, West Virginia, the following described property being the surface of that certain real estate located in CITY OF BECKLEY DISTRICT, RALEIGH COUNTY, WEST VIRGINIA, and more particularly described as follows:
BEING LOT 7 of SECTION 4 of the Combs Addition of Beckley, Raleigh County and so designated on a map of said Addition of record in the Office of the Clerk of the County Commission of Raleigh County, West Virginia in Miscellaneous Record Book No.1, at page 37, and particularly described as follows, to wit:
BEGINNING at a stake at the intersection of Hill Street and Second Street; thence with the line of Second Street a distance of 90 feet to a stake, corner to Lot No. 8; thence with the common line between Lot No.7, and Lot No.8; (incorrectly referenced as Lot No. 81 in a deed dated January 29, 1986 by and between Sue S. Martin and Robert L. Martin, to David Coda Houck and Jessica Lynn Houck, the said Deed being recorded in the aforesaid Clerk’s Office in Deed Book 705, at page 753) 76.82 feet to a stake, corner to Lot No.6, thence with the common line between Lot No.7 and Lot No.6, 111.07 feet to a stake in the line of Hill Street, a common corner to Lot No. 7 and Lot No.6; thence with Hill Street, along the said Lot No. 7 a distance of 68 feet to the point of BEGINNING.
And being the same property conveyed unto Henry Perdue and Michelle Perdue by Deed dated the 30th day of July, 2003, which Deed is recorded in the Office of the Clerk of the County Commission of Raleigh County, West Virginia, in Book 5010, at page 2540.
This conveyance is subject to all reservations, exceptions, limitations, restrictions, and conditions contained in all former conveyances of said property or any part thereof, excepting those pertaining to race, color, or creed.
The deed of trust states that the address of this real estate is commonly known as 211 Hill Street, Beckley, West Virginia 25801.
J. Peter Richardson was appointed substitute trustee by the APPOINTMENT OF SUBSTITUTE TRUSTEE, dated July 12, 2021, of record in said Clerk’s Office in Book 5074, at page 2021.
This sale will include all rights, easements, appurtenances, improvements and structures that are part of the real estate described above. This sale will be subject to all restrictions, rights-of-way, conditions, easements and matters of record, mechanics’ and materialmen’s liens, if any, whether of record or not of record, and unpaid real estate taxes, to the extent any of the foregoing apply and take priority over the lien of the deed of trust.
TERMS OF SALE: Cash in hand on day of sale. The conveyance of the real estate will be by deed without any warranty, expressed or implied. The real estate and any improvements thereon will be sold in “as is” condition without any warranties. The successful bidder will assume the risk of all loss or damage to the real estate and any improvements thereon after the sale, and be responsible for all costs of the conveyance including, but not limited to, any examination of title, preparation of the deed, excise tax and recording fees. Any announcements made at the sale, including postponement of the sale and withdrawal of the real estate from sale, will take priority over published notices.
