RE: NOTICE OF VACANCY FOR MAGISTRATE IN DIVISION IV AN ESTABLISHING APPLICATION PROCESS AND PROCEDURE
ELIGIBILITY REQUIREMENTS
To be considered for appointment as Magistrate, the applicant must satisfy the following minimum requirements:
* At least 21 years of age
* High school diploma or equivalent
* Never convicted of any felony crime or any misdemeanor crime involving moral turpitude
* Resident of Fayette County
* Applicant must not be an immediate family member of any magistrate in Fayette County. (immediate family means the relationship of mother, father, sister, brother, child or spouse.)
* THIS POSITION IS NON-PARTISAN AND MUST BE APPOINTED ON A NON-PARTISAN BASIS
APPLICATION PROCESS
1. All applicants must complete the application form. Hard copy application forms are available in the Circuit Clerk’s Office and the Magistrate Clerk’s Office. Microsoft Word and PDF versions of the application form will be made available online at the website for the Supreme Court of Appeals of West Virginia. Application forms that are incomplete or illegible may not be considered. The Circuit Court will accept applications from Friday, August 20,2021 to Friday, September 3, 2021. No applications will be accepted after September 3, 2021.
2. The fully completed, original application form and one (1) copy thereof (along with other documents set forth below) shall be submitted by mail to:

Application forms (and other documents set forth below) may also be hand-delivered and submitted to the Circuit Clerk of Fayette County, 100 North Court Street, Fayetteville 25840. Do not send applications by fax or email.
3. In addition to the completed application form the applicant must provide a (i) cover litter referencing the vacancy being applied for, (ii) a resume and (iii) a writing sample. Recommendation letters are not required, but any recommendation(s) for an applicant must be made in writing only and must be submitted with the completed application. DO NOT have recommendation letters separately mailed or delivered to the Circuit Court. To be considered, recommendation letters must be included as part of the application packet.
Following the application deadline of September 3,2021, the Circuit Court will set interviews at its discretion. Not all applicants are guaranteed an interview.
The applicant chosen to fill the vacancy will have a projected start date (subject to change) of October 1, 2021.
TERM FOR THE VACANCY
Because the unexpired term for the Magistrate to be replaced is more than two years and because the vacancy will occur before the close of candidate filing period for the primary election in 2022, the vacancy for the remainder of the unexpired term must be filled by an election during the nonpartisan judicial election held concurrently with the primary election in 2022. See W.Va. ode 3-10-3(d). Accordingly, the Circuit Court’s appointee to fill this vacancy will remain in office from the date of appointment until a successor is elected and certified following the 2022 primary election. 1 See W.Va. Code 3-10-3 (d)(3).
