NOTICE OF TRUSTEE’S
SALE OF PROPERTY

A portion of Tract No. 11 on that certain map or plat entitled “PLAT SHOWING DIVISION OF PROPERTY OF THREE SISTERS PARTNERSHIP BEING A PORTION OF THE W.R. WILLIAMS ESTATE ON POUNDING MILL BRANCH”, which plat is of record in the Office of the Clerk of the Circuit Court of Tazewell County, Virginia in Plat Book 38, at pages 135 and 135-A.

In execution of a Deed of Trust dated April 11, 2007 and recoded on April 12, 2007 in the Office of the Clerk of the Circuit Court of Tazewell County, Virginia, in Deed Book 998, page 628, the undersigned, Toby Lucas, Jr., Substitute Trustee, acting pursuant to an Appointment of Substitute Trustee recorded in said Clerk’s Office on December 1, 2020 as Instrument Number 200003257, will offer for sale at public auction at the front door of the Main Street entrance of the Courthouse of Tazewell County, Virginia, 24651, on the 21st day of September, 2021, at 900 a.m., certain property described in said Deed of Trust lying in the County of Tazewell, Virginia, and known as 126 Sunshine Lane, Pounding Mill, Virginia 24637, and more particularly described in the aforementioned deed of trust.

TOGETHER WITH all of the right, title, and interest of TruPoint Bank in and to that certain personal property, as described in a certain promissory note, dated April 11, 2007.

As provided in the Deed of Trust and pursuant to the provisions of applicable law, the undersigned Substitute Trustee may exercise all of the powers, rights, authority, and duties granted in the Deed of Trust.

TERMS: Cash. A bidder’s deposit of up to 10 percent of the bid amount may be required in cash at the time of the sale. Additional terms and conditions may be announced at the sale. Closing shall occur at the office of the trustee within 10 days of the date of the sale, at which time the balance of the purchase price will be due and payable in cash. The property will be sold “AS IS” and will be conveyed by special warranty deed, subject to all liens, objections, rights, reservations, leases, covenants, conditions, easements, and restrictions superior to the lien of the deed of trust as they may lawfully affect the property. Neither the Substitute Trustee nor the holder of the note secured by the deed of trust will deliver possession of the property to the successful bidder. The purchaser at the sale will be required to pay all closing costs except the grantor’s tax. Real estate ad valorem taxes will be prorated as of the date of closing.
