Notice is hereby given that MABEN COAL LLC, ONE CARBON CENTER 13905 MACCORKLE AVE, STE 501, CHARLESTON, WV 25315 has submitted an application to the Department of Environmental Protection (DEP), Division of Mining and Reclamation (DMR) located at 1159 Nick Rahall Greenway, Fayetteville, WV 25840 for an Article 3 permit for the surface disturbance of approximately 113.43 acres in order to highwall and contour mine, and where part of the proposed permit area is within 100 feet of the right-of-way for Us Route 121 (approximately 3.6 miles south of the Slab Fork exit from US 121). A public hearing may be requested for this area of the proposed permit being within 100 feet of this public road, in the Sewell seam of coal.
The proposed operation is discharging into Unnamed tributaries of Allen Creek and Allen Creek of Guyandotte River of Ohio River. of OHIO RV and is located 5.6 miles, northeast of Mullens in Slab Fork District of Raleigh County, Longitude 81 20 51 Latitude 37 39 39

Written comments and/or requests for an informal conference of the surface mining application shall identify the applicant and application number and will be received by the Permit Supervisor at the DEP address above until November 11, 2021, or thirty (30) days from date of final publication. A copy of the application will be available for review until November 11, 2021, or thirty (30) days from date of final publication in the DEP Regional Office located at the address above AND in the Raleigh County Clerk’s Office during normal business hours.
