TO: Any and All Unknown Heirs or Beneficiaries of the Estate of Justin Lafferty. PLEASE TAKE NOTICE that Petitioner’s PETITION TO COMPROMISE AND SETTLE WRONGFUL DEATH CLAIM, will be brought on for hearing before the Honorable Michael M. Cochrane, Judge of the Circuit Court of Wyoming County, located at the Wyoming County Courthouse, 100 Main and Banks Streets, Pineville, West Virginia on December 21, 2021, at 1:00 p.m. Petitioner Jennifer Lafferty, by and through her counsel, has negotiated a proposed settlement of the Estate’s claims against Aracoma Coal Company, Inc. and Maxxim Shared Services, LLC for a confidential sum of money, only to be disclosed by the Court, upon its sound judgment. This settlement is a final settlement of all perceived claims of the Estate against Aracoma Coal Company, Inc. and Maxxim Shared Services, LLC in this matter. Upon approval of the settlement by the Court and the subsequent execution of the settlement documents including a release and dismissal order, any other claims the Petitioner, the Estate of Justin Lafferty may have against Aracoma Coal Company, Inc. are forever barred and may no longer be pursued by them. All known individual heirs and beneficiaries referenced above as well as any and all other unknown heirs and/or beneficiaries of the Estate of Justin Lafferty are invited to attend the scheduled hearing to protect their individual interest in the Estate of Justin Lafferty or file a written response with the Wyoming County Circuit Clerk, 24 Main Avenue, Pineville, WV 24874 by December 21, 2021 at 1:00 p.m.
