NOTICE OF TRUSTEE’S SALE

In execution of the deed of trust, dated December 23, 2019, from Montario D. Wright to Jefrey D. Noble, as trustee, of record in the Office of the Clerk of the County Commission of Raleigh County, West Virginia, in Book 5070, at page 8958, the undersigned trustee will offer for sale at public auction on January 5, 2022, at 11:00 a.m., at the Main Street entrance of the Raleigh County Courthouse, 215 Main Street, Beckley, West Virginia, the following real estate is situate in the City of Beckley, Raleigh County, West Virginia, and being more particularly bounded and described as follows, to wit:

PARCEL I: All that certain lot or parcel of land, situate in the City of Beckley, Raleigh County, West Virginia, and being Lot No. Four (4), of the “Hager Sub-Division, Beckley, W. Va., K. M. Jarrell and other, Owners, as shown in the map thereof, of record in the Office of the Clerk of the County Commission of Raleigh County, West Virginia, in Map Book 7, at Page 56.

PARCEL II: All that certain lot of land situate in the City of Beckley, Raleigh County, West Virginia, as shown on map of the Hager Addition, of record in the aforesaid Clerk’s Office and also on a plot plan of record in the aforesaid Clerk’s Office in Deed Book 374, at page 252a, and being more particularly bounded and described as follows:

Beginning on Hager Street 231.45 feel from intersection of Harley Avenue, a corner of lot herein conveyed and the property of J. W. Bennett (now Kendall), thence with the line of Kendall, N. 26o 48′ E. 147.49 feet to a point in the southerly line of a one foot reservation; thence with the southerly line of said reservation, N. 63o 15′ W. 38.82 feet to the corner of Lot 4 of the Hager Addition; thence with the line of said Lot 4 of the Hager Addition, in a Southwestern direction to a point on Hager Street; thence with Hager Street, S. 63o 15′ E. 39.48 feet to the point of beginning.

And being more particularly bounded and described by a more recent survey as follows:

A parcel of land situate in the City of Beckley, Raleigh County, West Virginia and being Lot No. 4 of the Hagar Subdivision, K. M. Jarrell and others, owners and an adjoining parcel of land, and being more particularly bounded and described as follows:

Beginning at a set steel pin by a 4 inch square post in the north line of Hagar Street, point being a common corner to Lots. Nos. 1 and 4 of the said Hagar Subdivision; thence leave Hager Street and with the dividing line of Lot No. 4 and Lots Nos. 1, 2, and 3; N 28o 03′ feet for 148.38 feet to a set steel pin at a 4 inch square post in the south line of Lauren Avenue, (formerly Cook Street), point being a common corner to Lots Nos. 3 and 4 of said Hagar Subdivision; thence leave Lot No. 3 and with Lauren Avenue; S 62o 52′ E for 87.80 feet (passing a corner to Lot No. 4 at 50.00 feet), to a set steel pin by a round post; thence leave Lauren Avenue and with a line; S 27o 27′ W for 147.78 feet to a set mine roof bolt in the north line of said Hagar Street; thence with Hagar Street; N 63o 15′ W, (passing a corner to Lot No. 4 at 39.37 feet) for 89.37 feet to a point and plat of beginning, containing 12,117 square feet as surveyed by Dennis J. Lilly of Beckley, West Virginia, Land Surveyor License No. 256 and shown on a current map entitled “Property Map for Rachel E. Wright”, dated October l6, 1993.

And being the same real estate conveyed unto Rachel E. Wright, single by Howel D. Nelson and Mildred A. Nelson, husband and wife, Deed dated October 21, 1993, to be recorded in the Office of the Clerk of the County Commission of Raleigh County, West Virginia, in Roll 46 a page 2527. Rachel E. Wright died intestate on October 2, 2016, and leaving as her sole heir at law her son Montario Demarcus Wright.

The deed of trust states that the address of this real estate is commonly known as 105 Hager Street, Beckley, West Virginia 25801.

J. Peter Richardson was appointed substitute trustee by the APPOINTMENT OF SUBSTITUTE TRUSTEE, dated December 3, 2021, of record in said Clerk’s Office in Book 5075, at page 3633.

This sale will include all rights, easements, appurtenances, improvements and structures that are part of the real estate described above. This sale will be subject to all restrictions, rights-of-way, conditions, easements and matters of record, mechanics’ and materialmen’s liens, if any, whether of record or not of record, and unpaid real estate taxes, to the extent any of the foregoing apply and take priority over the lien of the deed of trust.

TERMS OF SALE: Cash in hand on day of sale. The conveyance of the real estate will be by deed without any warranty, expressed or implied. The real estate and any improvements thereon will be sold in “as is” condition without any warranties. The successful bidder will assume the risk of all loss or damage to the real estate and any improvements thereon after the sale, and be responsible for all costs of the conveyance including, but not limited to, any examination of title, preparation of the deed, excise tax and recording fees. Any announcements made at the sale, including postponement of the sale and withdrawal of the real estate from sale, will take priority over published notices.
