Petition for determination that the District is a Distressed or
Failing Utility under W. Va. Code § 24-2h-6(a).

NOTICE OF PUBLIC COMMENT AND EVIDENTIARY HEARING

On February 17, 2021, the Public Service Commission opened a proceeding to consider whether, pursuant to W.Va. Code § 24- 2H -6( a), the Boone Raleigh Public Service
District is a distressed or failing utility. The Boone Raleigh Public Service District provides service as a public sewer utility to approximately 380 customers in the communities of Sylvester, Elk Run, Seng Creek and Janie, Boone county, West Virginia.

The Public Service Commission conducted public comment and evidentiary hearings in the case on December 13, 2021, in Whitesville, West Virginia. The Commission will conduct further evidentiary hearing, to be conducted remotely, beginning at 9:30 a.m. Wednesday, January 12, 2022, for the sole purpose of receiving testimony from Boone County Public Service District’s Chief Operator, concerning the statutory elements of the Distressed and Failing Utilities Improvement Act, W.Va. Code § 24-2H-I et seq., including whether the Boone Raleigh Public Service District is a distressed or failing utility, and whether Boone County Public Service District, West Virginia-American
Water Company or Bradley Public Service District are capable proximate water utilities.
